I have been married to a women from Ukraine for fourteen years .Her sister recently had a interview for visitation visa and was denied.The interview was less than one minute,she was asked two questions.Question one what is the reason she answered to see her sister,question two have you left Ukraine in the past two years she answered no.At that point she was told she was denied.When she asked why she was handed two sheets of paper one in english one in ukrainian and told to leave.The paper she was given stated two main reasons for being denied.Reason one not enough reason to return.She has two adult sons living in Ukraine,she recently became a grandmother,she owns property,she has been employed as a school teacher for the past twenty five years and is expected to return in september,she had proof of all of this.Reason two no invitation from someone in USA,she had a copy of me and my wife's passports,our marriage certificate and a notarised invitation letter from us.She reapplied I would be thankful for ant suggestions that might help for her second interview.

Don't think age is the issue here...

She has two adult sons living in Ukraine,she recently became a grandmother,she owns property,she has been employed as a school teacher for the past twenty five years

It is actually easier to petition for a green card than a VISA in this case since her daughter lives here (if she is a US citizen, which after 14 yrs should be...)


Downside is I think she would need to live here in US half the year?

There is a Ukrainian woman working as an interviewer for the American embassy in Kiev. Did your SIL(sister in law) have a Ukrainian woman as an interviewer? If so, she needs to get a different interviewer because that woman denies almost everybody.

My MIL worked as a doctor and had property in Ukraine. She's travelled to Africa and all over Europe but denied a tourist visa to America.

I contacted my Congressman and his team involved in visas helped me out. They wrote a letter saying my MIL would be a good candidate to visit America with the congressman's signature. They told me to put the letter in with the documents she is to take to the interview. My congressman's office called the embassy and I also called the embassy and to tell them I got a letter and where to email it to. When my MIL got to the interview, she got an America man for an interviewer. He knew who she was and asked very few questions and she easily got a tourist visa good for 5 years.

Congressmen can't tell an embassy who to grant or deny visas to but Congressmen do vote on the budget of the State Department. It's best embassies don't piss them off.

A tourist visa is designed to bring money into America. Don't tell them you're paying your SIL's way.

The refusal rate for visas for Ukraine is not that high at 34.54% so she stands a chance of getting a visa. That being said my Russian wife was denied a visa to the US for a vacation when we were married and given exactly the same reason.

When I talked to a lawyer friend who specializes in immigration she said detail the appeal application in exacting detail. My sure all the problems mentioned are covered and more.

Get a letter from her school saying she's scheduled to return to work and include the date and what her duties are. Make sure the name of her employer and address are included. Photos of school also. Copies of her pay stubs from her job(s). If she has money if the bank get documentation proving it. Photos of her children and grandchildren. Documentation and photos proving she owns property. Make sure to include copies of medical insurance for her for her time in the US. Medical insurance coverage is often overlooked and according to our lawyer is a big concern to the government. Do the same for the invitation.

In the end we decided not to appeal my wife's visa denial and went to Thailand on vacation. My wife had no problems getting a visa for Thailand.

Yeah, even for a sister....
Not being married and also being nice looking are 'red flags'.
But being a teacher should have been a plus.
Chances are [next time] there will be a different interviewer.

Your wife should visit her, and then they together should visit a few Schengen countries - Hungary, the Czech Republic , perhaps Germany.  On a separate trip, the sister should visit Poland, which is not far and not particularly expensive.  If she has, or obtains, a biometric passport, she doesn't need a visa.

With evidence of foreign travel and a return to Ukraine, she will have a better chance at a visa in the future.

My MIL been to most of those countries and also Italy. It didn't work for her.

The second interview for the SIL is on schedule and been paid for. It's best she don't cancel and go to it. She's been denied for not having an invitation letter and not showing enough proof she has a good reason to go back home. Travelling to other countries help but none of that proves she has a good reason to return home, it only proves she returned home after travelling.

Can't appeal a consular officer's ruling if they feel the applicant didn't provided enough proof. Burden of proof lies with the applicant. Consular officers are allotted a lot of discretion when making their decision. Fortunately our government lets people apply for a tourist visa as much as they want as fast as they want to provide the proof. Even if an appeal was available, it's cheaper and faster to reapply for a tourist visa.

There are things that can be reversed with a waiver or appeal. Say an applicant has a criminal record or carrying a deadly transferable disease. They can appeal or apply for a waiver for those things.

The woman I was talking about is Ukrainian and she had an attitude. Most of the people in the waiting room isn't there for the first time and many of them talk amongst themselves they hope they don't get that interviewer.

What do you mean she didn't have a chance to show them the proof? Most of the time the interviewers make their ruling before the interview. Evidence should be in the packet of papers the interviewer reviews before the interview. I know the application has to be done online and it's been some years so things may have changed but regardless, tell her to get her proof in before the interview.

Keep in mind, every applicant there thinks they got enough proof they'll return home otherwise they wouldn't pay good money to be there. Every interviewer has to show they're doing their job by rejecting a good portion of applicants. Your SIL may have 100% of the proof she needs and still be rejected.

If you contact your Congressman and talk in a mature manner, you'll probably get help. The consulate office may give your SIL an interviewer that will grant a tourist visa. Squeaky wheel gets the grease.

donedidit, I went back and read your old posts. In 2012 and 2017 you asked questions about the tourist visa for SIL. Last year her pension paid $60 a month. Realistically, she can't show she's making good money so there's a good chance she will always be denied a tourist visa. I recommended calling your Congressman in the past. I still think that is your best shot now.

I read Jack Bragg helped you find your wife on one of his tours. He passed away. He's right you escort your in laws to the interview and you will get to the front of the line since you're an American citizen. If you decide to go with SIL, you can walk up to the interviewer's bullet proof window with your SIL to make a presence. The interviewer will ask who you are. Say you're an American citizen and give your name and relation to SIL. It may help. It won't hurt except in the pocket book since you have to travel to the other side of the world.

yes we did think that last year we would have her come visit but it never happened,you say that the documents showing her ties to Ukraine the interviewer should have before the interview now I am thinking she did not fill out the application properly,I am sorry to hear about Jack it was his prodding that convinced me to take the trip,he said it would be life changing and he sure was right.

It's been years since I helped someone with a tourist visa application but your SIL needs to attach evidence at the online application or supply the evidence when she checks in for her interview. Providing the evidence needs to happen before she walks up to the window for her interview. I think there are companies in Ukraine that you can hire that will help make sure everything is done properly but they won't guarantee anybody getting a visa.

That's going to cost a lot of time and money and it will be ineffective. Doesn't matter if she travels to other countries which have lower thresholds for granting visas, she still needs to prove to our consulate she has something of value to return home to.

I didn't read through the posts although the OP now has two people who

My MIL's passport is near full of stamps from travelling all over Europe and she was still rejected for a tourist visa to America. It doesn't matter if a person meets the criteria for 100 countries to get tourist visas to their nation, go there and return home everytime, if that person doesn't meet the criteria to get a tourist visa to America, they will be denied.

Best way to be sure you're gonna get a tourist visa is if you have already been to the US and came back.
