Engaged in Lviv!
« on: November 07, 2019, 10:52:53 PM »
Hey everyone, been a year but I figured I'd bring a few folds up to date even though I've kept in contact with a few of you outside of RWD, mainly Hammer2722. Last August I met a girl on Fdating. Short version is I've been there 3 times for a total of 6 weeks and things went mostly perfect. I went to see her last in April, June, and August/September. In August I proposed. Hired a contractor off Fiverr to make a VR Video Game level (Did I mention we're both nerds? We are.) I bought her a VR headset so we could "watch" movies together. I have a Plex server so we'll both choose a movie and watch it online together. she speaks 6 languages English, Russian, Ukrainian, some Hungarian, conversational Norwegian, and Swedish (Aunt and cousins are there).

Anyways the trip report yeah yeah, So In April everything went perfectly, I met her family, Parents, Grandparents (Babushka loving me was a HUGE plus) brother, etc. It was great. We went to Kyiv and had a great time, saw Chernobyl. She got mad at Germans Cheesing at the statue. she had never had breakfast delivered to the room before so I figured meh for $1 why not? Was an awesome breakfast, you submitted a menu order the night before. Maybe it's just me but damn if the food there doesn't taste 7x better than our flash frozen or Microwave Hotel Breakfasts. After that I met the Parents for the first time. I brought a few gifts for everyone. Shirts from Texas for everyone, a Set of Ratcheting Spanner Wrenches for the dad, he's an Avionics Engineer and loves working on his car, an Amazon Alexa show for the brother (In IT and Enginerding like me), some high quality perfumes for the mom, and a few novelties and other things for the parents. They got me a bunch of stuff as well. The Dad gave me a really nice Custom Fishing Rod and reel so next time we could fish, the Mom gave me a lot of chocolates, the Grandparents gave me some Caviar and homemade cookies.

In June we really mostly went to Castles from a few different places Kamianets-Podilskyi, Khotyn, Bastion in Ivano Frankivsk, etc. Met with several of her friends all of which approved of me. Saw the grandparents again and they gave even more chocolate and Cookies. I brought more shirts and American Novelties they thought were awesome. Her Laptop had been kinda Dying for a while overheating and poor quality and couldn't even play Fortnite (What?) So I bought a laptop with a busted display and broken fan, Added some memory and fixed the display (Ribbon Cable) and a new fan with some Liquid Metal replaced the TIM and for $350 I had an $1100 Laptop :D Her friends and family thought that was awesome that I "Built" it for her. Her dad has a "Side gig" mostly reselling working parts for Samsung and Dell Electronics so he thought that was more impressive.

August was the Best/Worst experience mostly due to fighting the Airline Companies. I tried for 4 days to get out of Charlotte to Ukraine and 3 days my flight got cancelled. Never Fly with Jet Blue. Was Supposed to leave Aug 21 but ended up not leaving until the 24th. Still fighting it with my CC companies. I wanted to Propose to her on the day and Hour we first met a year ago but they Airline companies compromised that. So the Day we got there after picking up the SUV from the airport and heading home I proposed to her. I loaded the VR program on my phone and plugged it into the VR headset and she was in Tears at the end saying Yes. After that we met with her family and they were shocked and super excited (They had known for a few months) The Ring I had made was from my Mom's original Diamond before she passed away so It was super meaningful to her. Her parents passed around the sparkling wine and actually gave us money, About $1000 between her parents and Grandparents, I definitely didn't expect that!

she had to work the next 2 days but after that we flew to Copenhagen Denmark, a gift from her parents for my birthday in June, I had bought the Apartment (Against her wishes) and man....it was absolutely abhorrent, stains on the mattress, Calcified windows, broken hotplate, messed up shower and bathroom rack. We were there for 5 minutes 4.5 of which were finding a new hotel. Ended up staying in a nice Tivoli Hotel (At $350 a night) but at least it was clean and I didn't think I would get bed bugs or be laying in someone elses spunk. Other than that, Although Expensive and difficult to Navigate Copenhagen was a really great time.

So to end my Trip update if you read this far, uh yeah, based on those nights in Copenhagen, she's pregnant and is due in May. Luckily I put a ring on it before getting the news but the parents/grandparents would like me to marry her before she has the baby.

What a fun story.  Congrats!  Won't be too long of a honeymoon with baby on the way already.  Um, what was the last picture for?

Thanks for sharing IvanM07. It's a wonderful experience courting a find FSU woman. A few of us on this forum had that experience. I definitely won't forget mine.

Now that you're engaged, are you planning to file K-1 fiancée paperwork immediately? If so, are you going to make the grandparents happy by getting married before the baby arrives? Getting married may void the K-1 unless you have a ceremony without reporting it to the government. Another option is to marry first and then start the paperwork to bring a wife to America. Personally, I'd choose the option that brings you two and the child together soonest.

So tell him in clear terms which option achieves this.

So tell him in clear terms which option achieves this.

I can't give Ivan clear terms since the government doesn't provide us with clear terms. IF Ivan wants the fastest option he will have to use the calculator below and make his own decision. He will have to figure out the service center that will handle his paperwork. Most likely it will be the service center closest to where he lives but there are no guarantees. Then he will have to check the processing times of the I-129F fiancée visa and compare it against the processing times of the I-130 spousal visa to see which that specific service center processes fastest. Another issue is a baby will be born before the paperwork is completed. Ivan needs to review the I-129F and I-130 documents to see if he and his fiancée can even use only those forms or will need addition forms since they are initially applying for a visa for one but will need two visas by the time our government processes their paperwork.

http://egov.uscis.gov/processing-times/

Before we spend too much time helping Ivan, lets first find out if he wants help. He may already have a concrete plan that isn't going to change.

Usually you would have to wait at least 30 days from the time you register and the wedding date in Ukraine. However, in your case, you can ask for a quicker date.

There is an extreme small percentage of people in this forum who were married in Ukraine.

Hi Ivan,

Congradulations!  By coincidence, I proposed to T in Lviv as well, last June.  Happening town.

We went the K-1 route. I submitted the I-129F at the end of June (2018), and T arrived in Boston Logan in Feb (2019).  8 months from submittal to arrival.  We were about a month ahead of the average at visajourneys.

So, I highly doubt you will be able to use the K-1 route if you want to marry before the happy day.

Right now IR-1/CR-1 is tracking about 18 months.  I believe that is the only feasible option for you.  Get married in Ukraine (I am not sure of that process - something about ZAGS?) and then apply for the spouse visa.  Good news is that the spouse visa is less expensive overall and she will arrive in the US with a greencard, versus having to apply for the adjustment of status and being "trapped" in the US waiting for AOS.

Congrats to the two (three) of you!

My only thought about getting back to the States was the baby.  Is it possible to get your fiancee here to the States for the birth?  Though, maybe that is out of the question with her family.  My reasoning is then the baby is a US Citizen by birth and less of a headache with paperwork for you guys.  Only one visa to get instead of two.

Thanks everyone for the wishes and plans and everything!

Originally we had tried to go the Tourist Visa route and apply for a change of Visa with an Attorney, but either USCIS saw that we were engaged on social media (Even though I could swear I scrubbed everything) or something else since the entire family was denied. Yeah that wouldn't have been the smartest in terms of Legality and Ethics but at least she would have been back with me in January after I go to see her then :/

Still using the same attorney through work's Legal Insurance probably going to do the K-1 as everything I've read on the Spouse visa is somewhere around 12-18 Months as was mentioned. I think the Run time on the K-1 is around 8 months or so?

I would ideally like to have her here before the baby is born but at the same time it could be better for her to be there around her friends and family during that phase and if there's any Postpartum Depression the added anxiety of a new country, new friends, new environment, different language and having to drive everywhere rather than taking public transit for everything might be too many added stressors.

Work gives me 2 weeks paternal leave and I'll have about 5 weeks saved up plus FMLA so hopefully I can be there for about a month to month and a half before having to come back.

Ivan,

Just a thought:   While it would be great to be there when the baby is born (and I recommend it) I would not blow all of your leave in the baby birthing process.   While I am sure you would like to play diaper changer and 2 AM feeding specialist, I am willing to believe your intended's family would jump at the chance.

Why do I say this?   Because, deep down, this is still an Eastern European family.   The men are not expected to be immediately involved with a new baby, except to hold them occasionally, etc.   These are some conversations that you might want to have - i.e. what expectations your intended has.   Then you can stage the vacation time you HAVE saved up to time that you will want to use waiting for the visa(s) to arrive.

As I said:  Just a thought.

If this is the first marriage for your girl, she would probably want to get married with all her family there; which means in Ukraine. Yes, there is a certain procedure and you would marry at RAGS (ZAGS) but you can still have a church ceremony too.

Other visa options are K-3/K-4 combined with the Cr-1/Cr-2

Direct consular filing at the US Embassy, Kyiv. With this option, you would not deal with USCIS nor NVC at all. Everything would be done at the embassy level. This procedure would take about 2 or 3 months.

If you are married before the child is born and you are listed as the father on the birth certificate, you can apply for the child's US Citizenship right away.

I was under the impression that DCF was only under exigent or exceptional circumstances?

Currently the plan (At least as we had figured it would go) is that we would just sign the papers at a local courthouse in the US once she had immigrated over via K-1. That way she could have the actual Ceremony and everything in Ukraine so my family and friends as well as hers could be there. She was assuming the planning phase would be about 6 months-1 year so it made more sense to go this route with the Visa, US marriage, then UA Ceremony.

This is our first Marriage for both of us. Of course her family would really like that we be married before the baby is born, but if I did that I'd have to go with the much longer Spousal visa. I also don't know how it would work with regards to the Visa process and if they'll need a blood test or anything like that or if it will cause any complications in the process.

A church wedding is not legal in Ukraine, so you would not be considered legally married by Ukraine.

However, church weddings are legal as far as USA is concerned and if USCIS finds out about it, they could reject the petition.

Then you could file for the CR-1 as a last resort.

I've heard more people complain the spousal visa takes longer than a fiancée visa. Their experience may not be yours. It really depended on factors within the service center you send your document to.

Does that attorney specialize in immigration and if so, did that attorney recommend you filing for tourist visas for the whole family that ended up getting denied? Tourist visas are hard to get and unless certain conditions are met, it's almost a 100% denial rate if a person doesn't meet just one condition. If you asks questions here first, we may have saved you a lot of money before you spent it on an attempt to get the whole family tourist visas. We're also a whole lot cheaper than an attorney.

I gotcha, I just meant basically to file the K-1, after it's approval get her and the baby here, then go to a JP and sign the documents here in the US then start planning the ceremony in Ukraine with the rest of her family and everything.

Yeah, the attorney specializes in Immigration but I think he practices other civil law cases. That was more my plan in an attempt to try to get her over here as quickly as possible, I had tried to pay for the Tourist Visa Fee's but her family wouldn't let me and paid for it themselves. Luckily with the Legal Insurance through work this is covered and I don't have to pay them out of pocket so that's a plus at least :)

There's a new job I'm working on the next round of interviewing for that would be a lot easier to see her more often and put me back in Texas rather than NC. If it works out it'll be a pay jump as well as working 4 weeks then off 6 weeks so I could go over a lot more and still have a constant paycheck, hoping it works out that way since even with being in IT my current employer isn't a huge fan of working remote.

. . . put me back in Texas rather than NC.

I would take NC over Texas every time.
Plus, gets you back and forth from Ukraine quicker.

On weddings in Ukraine:  All go to government location for legal wedding, and then many go to church to repeat ceremony for family and tradition.

You also need to go to VisaJourney, establish an account, and get better more up to date advice than you will get here.

Shoot you seen the drivers here? I'm in Charlotte, Mecklenburg County. Highest Taxed region in NC. Not only that but as I said the drivers are all from NYC and haven't driven a car in 10 years. I've been here since July 2018. 4 wrecks. None my own fault, after the first I hired an attorney to go after them, we're on a first name basis now. Hell I went and had drinks with him a few weeks ago. Drivers are that bad.

Seriously though it would be better to be around family with a new kid on the way as well as adapting to a new place to have friends and family around. She gets along well with my entire family so this will help and I'm more than sure my Sister will be taking up residence for a while helping with the baby so that will be good too.

Headed back over Saturday for 2 weeks, Her folks bought us tickets for a flight to Warsaw. Anything that might be interesting or worth seeing? I don't know much about the City unfortunately, only that it's home to a video game developer I really like haha.

I had wanted to see the science museum and tomb of the unknown soldier, but that's probably not as interesting to her. Any Ideas would be appreciated!
