Question about K2 Visa Requirement
« on: August 10, 2019, 04:46:43 PM »
I am in the process of doing the work for my girl with the K1 Visa and her daughter who is 18 years old a K2 Visa. Some people say that the daughter will need fathers approval because he is on the birth certificate and some say no.

Does anyone have any idea what the rule is? It seems since she is 18 the father does not need to approve this. But I am not sure what the rule is.

And is this a USA rule or a Ukrainian rule?

Q.8 I am applying for a K1/K2 visa. I have temporary permission from the child's father for a trip to the United States. Is it a valid enough document to be provided to the consulate? We can not assess the validity of documents in advance. During the interview the consular officer will review your documents and tell you if they are enough. You must be prepared to verify the right to bring the child abroad and to provide relevant documents. Government of Ukraine has certain requirements for taking children abroad. Please refer to the government of Ukraine regarding requirements for documents for taking a child abroad in your particular situation.

Your fiance should be able to find out the requirements. Let us know how it went.

Thanks for the suggestion. I did just what you said and told my girl she needed to check on her side. She got on the phone with the right office in Kyiv first thing Monday morning and found out the rule. Since her daughter is 18 years old she is an adult and does not need permission from her father for anything.

This is what I thought but someone told me differently. So hope that helps anyone else working on a K2 with an adult child.

But be aware that such children 'age out' at some age and cannot be brought to USA under mother's application.

Two conditions must be met for kids to qualify for k-2. They must be unmarried and under 21 the day they come to America.

Also...A prospective K2 may be subject to the same background check [police records etc] as an adult.
