immigration, fees and refiling
« on: December 05, 2007, 07:37:21 AM »
In my job if we screw up, we do not as a rule hold the person whose case we fouled up accountable.

Why then does USCIS require a person to refile and pay those exorbitant fees when it was USCIS that was clearly at fault?

Shouldn't someone be questioning these tactics?

In the 'real' world people are made accountable for misdeeds why is USCIS allowed to take the money over and over again?

Are there legal ways to avoid having to pay to refile if it is not your fault someone at USCIS happened to lose the application?

Uhhhh- they DONT require a repayment of fees on active files if it can be shown that it is their fault. SOC- you need to be a little more specific on what the facts are.

If they lose the file during processing then yes-the file has to be reconstituted.
But that doesn't require new filing fees. Because you have a receipt that shows payment or a cancelled check. . . . .

Are you referring to additional work permits and travel docs?

I mean like what Jet and catzenmouse have been going through.
They have been treated unfairly.

IC- extension on EAD and AP is what you are referring to. That problem may come to a close with the fee consolidation. In addition, govt. relaxation of fear-mongering and a return to business as usual would certainly be a step in the right direction.

IC another problem in the future with delay of applying for natz and the future right for the petitioning of the third and fourth tier of immigrants
