Non-Standard immigration Questions
« on: July 16, 2011, 03:56:46 PM »
I have a request from the Mrs.
A family friend has a daughter. This girl was born in Switzerland, to a Swiss father while the lady was working there. The daughter never returned to Odessa, so she DOES NOT have Ukrainien citizenship.
Last year, the daughter got married to an American man who was working in Switzerland. They have no plans to return to America in the near future, but want to keep their options open.
Swiss citizens do not require a visa for entry, but what if she wants to move here? By the time this happens, they will likely to have been married for years. What about SS?
N has not found anything on her RW forums----any help or suggestions would be apprecieated. I am told the couple have made repeated inquiries at the embassy in Bern---they are not offering any suggestions either.
Experience is what you get when you didn't get what you wanted.

There is nothing non-standard.

At the time when she decides to move to the USA, her husband must apply for a spouse immigration visa. Otherwise, she can travel with him to the USA because a tourist visa is not required.

As a Swiss citizen she can travel to the US freely. Different set of circumstances for residency that will involve a green card.  However, working is another separate matter to deal with depending on if she wishes to work before obtaining a green card or after and what she plans to do. Too many variables to guess. I would say if this lady isn't interested in working right away they'd have no problem.

I have a friend (AW) who married a Swiss. She met him online, she went to visit him, him to visit her. They decided to marry and live here. According to her, they had some formidable hoops to jump through before he could obtain his green card and work at all. He is a highly skilled and specially trained nurse of some sort but, no hospitals (where he applies his expertise) would hire him without a resident status. To my knowledge he's never tried for citizenship. The guy actually won some money in the lottery and they wouldn't pay it until his resident status was sorted out.
