Certificate of Marriagability...

Hello all,

I am engaged to a girl from Yalta living in China. We plan on marrying outside of Ukraine. She is going home to Yalta for a month.

Most other countries are asking for a CERTIFICATE OF MARRAIGABILTY or a legal document with an apostille stamp saying she is single.

What is the process for this?

Can this be done all locally in Yalta or will she have to go to Kiev?

Any help would be appreciated.

I don't know for your country, but for me , it was (as french) a certificate of capacity of marriage that was delivered by the french embassy in Ukraine. I needed to have my birth certificate with apostille, this paper and make them all legalize in the ministry of foreign affair in Kiev to get this certificate. Call your embassy in Ukraine, they will give you all details you need. If you will marry outside of Ukraine, check the local requirement for your citizenship and for a ukrainian woman (they can be different) and if the ceremony is recognized in your country and in Ukraine.

I notice you are from Texas, so I am going to assume you are going to get married in Texas.  I also am in Texas and my Ukrainian wife and I have been married for over 10 years.  I dont think anything has changed, but in Dallas county I dont remember having to prove anything about marriage.  We just had to swear that we were not already married, at least I think we did.  It has been many years ago.

I have found she needs to go the the ZAGS office in Yalta, but does the for the apostille stamp, Does she have to go all the way to Kiev in person?

She should contact the ministry of justice who is responsible of it

i had to provide that certificate to get married in Belgium. From what i found on the internet, there are 2 ways to get this paper. #1 is go to a notary and make a statement, I, name, hereby state that at this moment i am not legally married, blablabla, then put apostil on this paper, and translate, thats what i did. But this paper doesnt always work, because all notary does is certify your signature, without certifying if you are saying the truth, but this paper often works, at least here in Belgium where any foreign citizen has to provide this in order to marry. #2 way is go to her local ZAGS and ask them for this paper, this one should work anywhere.
The other difference between the two is that you will have to go to different places to put apostil on those 2 papers. TO put apostil on a paper made by a notary you need to go to Ministry of justice (ministerstvo yustitsii - минюст), and to put apostil on a paper given by ZAGS you need to go to head archive of Zags

Thanks guys for all your responses.

I found a company in Ukraine that is very reasonable, by my eyes, about getting apostilles. $100 US for the Apostille and Translation + shipping.

She went to Zags this morning. Now we will mail this to the company in Kiev. This saves SO much time.

They even do police reports. If anyone is interested im me and I will forward the name. I am not going to advertise for them but they do have a website.
