Working in USA -- Timeline
« on: January 17, 2011, 01:01:48 PM »
Can someone clarify what is required, and the approximate timeline, for an FSU woman to be permitted (for lack of a better word) to work in the USA post marriage?

Make the assumption she is not going back to school to become a doctor or something similar.
Assume it is simple and that she has adequate English skills.
So something akin to working in sales at a mall, for example.

Thanks.

It doesn't take much as far as legalities Xman. An SSI card (which she can get almost immediately), being, "in-status" and a job. However, there are the other tangibles. What position she can find and qualify for as well as being able to perform at an acceptable level. Transportation to and fro. These are things they don't face in Mother Russia which can have an important bearing. But legally, they can start almost right away

She'll need EAD (employment authorization / work permit), or post-marriage she can get her SSN and be able to work at anytime she pleases (or can) after that.

For EAD, some folks said they got it during the 90-day period, while others said they didn't and had to wait until after marriage. For us, it didn't matter since the K-period and the immediate time after (+/- 6 mo) she arrived we spent mostly getting prepared for the wedding and also getting her adjusted and acclimated to the city at large.

But all else aside, working is largely subjective in the beginning. Language proficiency is of prime importance.

We had EAD on entry, and SSN number 1 week after arrival. The work authorization is only good as long as the K1 is, which means she can work for 90 days after entry, but then can not until AOS is complete. AOS (i.e. green card) we filed around Dec 15 and recieved green card around April 15.
