been awhile one quick question
« on: October 24, 2011, 06:46:00 AM »
Hope everyone is doing well.

My wife and stepson are both US citizens now.
Mike got his citizenship about a month ago and Iryna about 2 years ago.

I have one question.

I think I remember a post somewhere from an Immigration attorney stating "just because you have your US citizenship, don't think you are finished with USCIS."

Is there any truth to this statement?

Thank you.

In what context was the statement made, SOC?

From my personal experience, soon as I got my citizenship, USCIS and I had no unfinished business with each other anymore.

Marina has been a citizen of the GoodOl' USA for over 2 years now.
No more contact has been made to or from USCIS.
She is apparently done with them.

Once you are a citizen, UCIS is done with you.  The only reasons they would be interested (maybe) is if the person became a U.S citizen by fraudulent means and they wanted to revoke the citizenship.

I also think that once they get their citizenship, you are no longer..legally.. financially responsible for them.

I would be surprised if this were true.  Logic (which doesn't always prevail) would suggest the original sponsor is still on the hook for support for the full term specified, regardless of the citizenship status of the person sponsored.

Attaining citizenship does not automatically insure that the person can fully support him/herself and will not seek government financial support, which then comes back on the sponsor; as I understand it.

But again, I am just thinking this through logically, and have no actual experience.
A beautiful woman is pleasant to look at, but it is easier to live with a pleasant acting one.

You need to be careful with that thought process ML, you ARE talking about a governmental entity where logic has no place.  ;D

googler is your friend ,if interested..

Read the regulations, it's clear that the sponsor is no longer responcible ,as far as the USCIS is concerned,
after the immigrant gains US citizenship status, and/or has worked full time for 40(?) quarters.

Keep in mind someone could continue with a 2 ,
then the AOS to 10 year green card, and beyond ,without the 40 work quarters being met, or applying for US citizenship,
nd the origonal sponsor is still financial responcible if the person were to draw public aid in specific  various forms.

from the I 864 instructions:

How long does my obligation as a  sponsor continue ?
Your obligation to support the immigrant(s) you are sponsoring in this affidavit of support will continue until the sponsored immigrant becomes a U.S. citizen, or can be credited with 40 qualifying quarters of work in the United States. Although 40 qualifying quarters of work (credits) generally equate to ten years of work, in certain cases the work of a spouse or parent adds qualifying quarters. The Social Security Administration can provide information on how to count qualifying quarters (credits) of work. The obligation also ends if you or the sponsored immigrant dies or if the sponsored immigrant ceases to be a lawful permanent resident and departs the United States. Divorce does not end the sponsorship obligation.
