Possibly moving from USA to Canada
« on: May 23, 2012, 05:14:57 PM »
First, still working through custody issues (to clarify, she is working on obtaining custody, permission to leave the country, etc.), so nothing is a done deal as of yet.

I have an opportunity that I am uncertain as to whether I should pursue further.  If I decided to leave the US and work in Canada, would that then create an impossible scenario for moving forward with a fiance visa?  That would seem to be the case, but thought I would as and see if anyone had any feedback.

Thanks.

That's damn sure a different angle the Xman. Are you going to maintain a US residence? Hopefully some of the canucks will chime in but, it's highly unlikely you can have her enter Canada, would be my guess anyway

Are there any stipulations on how many days in country she has to be for a green card or AOS?  That's the first issue.

She won't be allowed in Canada until XMan is married to her.  Even then, she will need a special visa, as she is a Ukrainian, not an American.  It would be best to hire an immigration lawyer to get the paperwork moving, as in general, Canada Immigration is very slow, though that depends on the region.
After the fall of communism, the biggest mistake Boris Yeltsin's regime made was not to disband the KGB altogether. Instead it changed its name to the FSB and, to many observers, morphed into a gangster organisation, eventually headed by master criminal Vladimir Putin. - Gerard Batten

Fiance visa in the USA or fiance visa in Canada? If the latter, it won't work as Canada does not have a fiance visa. The only question is whether she could come to Canada with you as her husband if she does not have American permanent residence as presumably you will have a work visa or permanent residence status in Canada. Complicates matters quite a bit and would certainly warrant consulting an immigration lawyer.

Hate to give up on the idea, because it is one of those work opportunities that only comes around once.  I will see what I can discover through an immigration attorney.  May simply be too difficult to manage.

Thanks.
