I was cautioned against including my stepson as a dependent because he has no SSN. The taxpayer ID is also not advised if there is any chance the child may be obtaining a SSN. I filed for his EAD and it is progressing well and SSA says he can have a SSN if the EAD is accepted.

Have any of you had experience with this? Did you do an amended return when the child receives their SSN?

I was going to annotate "pending" or "applied for" on the 1040 but when I called IRS they said they would not pay the refund.

The difference if the child is included is about $1,000.00 in my case.

Don't let the SSN# stop you from claiming him. Last year I claimed my wife and she didn't have a SSN and the IRS withheld some of our return - but - we can still get that money back this year.

That whole deal really left a bad taste in my mouth and I promptly went tax-exempt after that. I estimated my taxes and I have money going into a special account every payday; I'll write a check in April. I would rather have the IRS bill me if there is a discretion than just withhold my money.

The proper way to deal with this (I am assuming that your wife doesn't have her green card or K visa yet) is to get a ITIN from the IRS.  The ITIN is a "International Taxpayer ID Number" this is used in place of a SS# for people in just such a situation.  You would get one for your stepson as well.

 

Just google ITIN and you'll see it.  Basically you need to submit a couple documents and do the whole thing by mail (no efile the first time) but then it just goes along fine.  I did it for 2004.

We have been marrid since August and she has been here since July. She has her EAD and I-131, I am waiting for the interview date for AOS. Paperwork was mailed October 6.

I was advised not to get her son a taxpayer id because I have filed for his EAD. If this is approved he will be issued a SSN. This was told to me by a manager at a SSA office. It is only a matter of 6 weeks for the EAD to be approved or denied.
