Who married in USA to woman who was on a visitors or student visa?
« on: September 01, 2013, 11:54:38 AM »
I remember Saltheart did this.
And KenC several years ago.

Anyone else come to mind?

As I understand it, via this route all the K type stuff can be skipped and just go directly to AOS procedures.
A beautiful woman is pleasant to look at, but it is easier to live with a pleasant acting one.

You are correct....as long as one can prove that the initial hook up was not intentional. If someone came here on those visas to circumnavigate the system that is visa fraud and people have been tripped up on that.

When I search for some tourist visa info for my MIL, I found some threads on visajourney that talked about the answers you're looking for. One person while waiting for her AOS to be completed overstayed her tourist visa. The advice she was given was this was ok as long as she doesn't leave the country until AOS was completed otherwise she will receive a 10 year ban from entering USA for violating the tourist visa.
Fund the audits, spread the word and educate people, write your politicians and other elected officials. Stay active in the fight to save our country. Over 220 generals and admirals say we are in a fight for our survival like no other time since 1776.

ML,

Simoni's wife first entered the USA with a student visa.  He had met her before in UA, and I believe she was here at least a year before marriage.

Simoni felt it important to retain an immigration attorney (William who used to post here).

Simoni and his wife have a delightful little daughter.  However, I have not seen them after he moved to take the position of Dean at a Western university.  He is very helpful, and I believe he would give you some advice, especially after telling him of Ochka's academic achievements.

It seems that you have a good position.  Based on Ochka's academic record, she obviously entered the USA to study and not to evade the law.   Further, some time has lapsed after her arrival.   However, I am no expert, and frequently I confuse justice with the law.

I wish you the best.

Although we went the K1 route we are friends with about 10 FSUW women (as well as a multitude of Brazilians, etc) who did this or are going through it currently. One of my best friends married a beautiful Russian woman a few weeks ago on an expired VISA and is going through the process now. It seems more common than K1 and K3 these days.

This is the only thing. The women cannot exit the country and visit home until the paperwork is in order. Other than that there is not much to it really.

As I understand it, via this route all the K type stuff can be skipped and just go directly to AOS procedures.

I believe you will still need to fill out many of the forms required for the K1 though such as 485, medical, etc.
