bypassing the two year card
« on: April 06, 2007, 01:12:18 PM »
I am hearing more and more scenerios of guys who completely bypassed the AOS and received the 10 year green card.

Do us 2 year card owners have a chance to remove conditions before the expiration of the 2 year card?

How much money do we owe USCIS for this pleasure?

I bypassed the 2 year card for my former spouse. It would require a delay on your part in filing the AOS or your case getting tangled up in red tape. The marriage to a USC is supposed to be over 2 years old at the time of the approval of AOS to allow for a permanent card. Otherwise the condition applies.

I would not waste my energy contemplating it further. Follow the path to success and do not ponder on bright ideas

William3rd, Doesn't a person have to get a conditional greencard first. Then the two year clock starts clicking? I had recent conversation with an immigration attorney and she said "the conditional GC takes about a year to get (Vermont Service Center) and then 2 more years to get the permanent. So three years". It's my understanding that the I-360 bypasses the 2 year wait and goes straight to LPR status. Shouldn't Son of Clyde just have his wife claim he did this  :cluebat: to her to speed things along??

They do not have to get a two year card first. However, there would also have to be substantial time either out of status or in limbo. My ex-may she burn in hell- had parole docs renewed a couple of times before I did a supervisory inquiry to get her the permanent card.

The date of marriage versus the date of approval is what controls. Also that the petitioner is a USC.

Due to post 9-11 visa delays we had been married over 2 years before the AOS interview and therefore went directly to the 10 year green card.

Thanks for clearing that up for me guys. I know some women who entered America last year as fiancees, claimed to be abused a few months after they married and now have their LPR cards. This is out of the V.S.C. area where everything happens fast.
