Emergency AP?

I came home yesterday to a very distraught UW. It took a while before she calmed down enough  to finally tell me the problem--5 years ago her mother had an operation for a tumor on her pancreas--now her mother is sick again. The doctors in Odessa are still doing tests; so the final diagnosis is not known. Of course, Mama, wants N. to come back now; but N. says not now, because she wouldn't be able to do anything to help.

We sent in the packet for green card, AP and EAD last week; we haven't received her NOA1 yet. I know that we will need the case number from the NOA1 to go forward, but can anyone tell me the procedure to apply for an emergency AP? Of course we are hoping it will not be needed---but just in case......

I know that we will need the case number from the NOA1 to go forward, but can anyone tell me the procedure to apply for an emergency AP? Of course we are hoping it will not be needed---but just in case......

Wait for the I-797 to come back, then make an infopass appointment to speak to someone in your local office in person. Bring the I-797, any relevant documents with translations (like something from the hospital or her doctor's office - and yes it can be a fax copy), 2 more passport photos, a newly filled out I-131 and a copy of the one you filed with the I-485 if you have it, and last but not least, another money order for the fee. Keep in mind that emergency AP is not guaranteed, our first experience trying to obtain it after Lil's Dad had a heart attack ended with the supervisor exclaiming "Ohh, he ain't DEAD yet? Well then it's not an emergency!"   :burnedup:

Jet, you make it seem like we will be filing an entire NEW I-131 application  :wallbash:

I actually made 3 copies of the entire AOS package; so we do have everything.

YMMV and it's possible with recent changes in the way they process these, that you won't - but that's what we had to do  :noidea:

MIL is supposed to have her final battery of tests today--not sure when she will have results

We got some good news on Saturday--No cancer! MIL still has problems, but the sense of urgency is decreased significantly.

Also on Saturday---NOA1 for the entire AOS package arrived in mail.
Today---a letter arrived scheduling her biometric appointment (August 16)
Since USCIS is moving relatively swiftly, we will hold off on the emergency AP for the moment. :whew:

Good news indeed---on both counts.
Everyone in Nataliya's family was very worried because of MIL's previous history.


As for the AOS; we are keeping our fingers crossed on that---Nataliya is starting to get cabin fever from not working.
I recently checked over on the VisaJourney website---AOS interviews are being scheduled anywhere from 2 weeks to 2 months after biometric appointment.

Rob, if our experience is typical, your wife may get her employment authorization card well before you have your AOS interview. Our timeline went like:
-March 10 filed AOS along with AP, Employment Authorization
-May 3 Biometrics interview
-June 24ish rec'd AP and employment authorization within days of each other

-July 31 our AOS interview is today, in 2 hours :)

Most of the other petitioners waiting with us had lawyers, there were a few RW-AM couples there but we kept to ourselves.

I'd spent the week prior to the interview putting together all our documents (the appointment letter you receive w/interview date will have a checklist of everything you should bring to the interview) and making sure we had copies of everything we previously submitted, but the only thing the interviewer asked us for was her Employment Authorization Card, which he confiscated as she doesn't need it anymore.

If I had to do anything differently I'd probably not apply for Employment Authorization or Advanced Parole, since we required neither before today (my wife will be returning to Moscow for a visit in Sept.) However, I suppose it's good to have both for peace of mind...

Scary easy but glad to hear it does happen sometimes. Odd about the EAD card. We didn't have an interview but they never asked for us to return the EAD card. Another one of those unanswerable mysteries of the USCISiverse.

BTW---Nataliya wanted me to find out EXACTLY what the procedure will be at her biometrics appointment. Fingerprints I know; but what else?

Thanks guys, the whole process is a bit nerve-wracking and tedious but I feel like a jerk complaining because so many others here have had nightmare experiences.

Funny enough, there was a lawyer sitting near us in the waiting room "counseling" her clients to get their stories straight on how they met and making sure that other particulars about their relationship (most were probably pure BS since they each had different details) were in line. I don't know which aspect was more depressing: the outright lies or the fact that the lawyer waited until 5 minutes before their appointment to clue them in.

Rob, Biometrics is a breeze, probably the easiest part of the process. When you arrive they'll take the NOA doc with your appointment info on it, fingerprint your fiancee, then stamp the doc and you're on your way. My wife and I had our BioM appointment in Manhattan and when we arrived there was one other couple in front of us, a huge and mostly empty room, and about a dozen extremely bored staff workers. I'd taken the day off anticipating we might have a long wait but we were in and out in about 10 minutes.
