New questions about my fiancee's returning to US
« on: December 20, 2007, 11:33:18 AM »
OK, my fiancee wants to come to US now and let her daughter remain with her grandmother until she finished 5th grade. She regularly stays with with her grandmother and she is a really good woman. Anyway, after we get married she wants to return to get her daughter. What other type of documents or problems might be involved with her re-entering the US?

After you marry and file for Adjustment of Status you can file for Advanced Parole while your AOS application is being reviewed. Unless it's a documented emergency you can expect to wait 2-3 months for the AP doc. My wife applied for AP last year and waited 3 months for the document to arrive, at that point we were weeks away from our AOS interview so we simply waited until she had her GC.

At the moment AP is averaging 60 days.   It has run as high as 90 about a year ago.    I have been paying attention to this since we are now working on the forms.
