Traveling under Advanced Parole (New Boring Topic)
« on: June 03, 2009, 09:10:24 AM »
As a refresher,  I am recently married to a lady from Kiev (Elena's Models).  We live in Kansas City (USA).  I applied for Adjustment of Status at the beginning of April.  We received Advanced Parole (I 512L) after six weeks, which I thought was pretty quick.  My question relates to anyone's experiences with obtaining visas for their wife with regard to international travel.  Is it easier for my wife to obtain a Schengen visa (for example) now that she is married and living in the USA?  Of course her passport is still Ukrainian.  What about Japan and Canada?

Any postings of international travel experiences or advice under Advanced Parole would be appreciated.  I apologize for the boring nature of this topic with respect to the more popular threads of the past two days. :)

Hello X633.

I'll explain this in a simple fashion (I hope).

Think of the Advance Parole (AP) this way:

Advance parole is a ticket (document) to let your wife back into the GoodOl'USA.

It really has nothing to do with her traveling overseas.

Your wife still needs ALL of her visa's (Schengen, whatever) and her Ukrainian Passport to travel to overseas destinations (or Mexico/Canada).

Also when you arrange flights for your wife be careful what airports she connects through.....some are still a problem.

Until your wife becomes a citizen (citizenship not Green Card) of the GoodOl'USA, you need to stay on your toes about her travels.

BTW....I like your sense of humor (boring)!!  :D

List of her visa requirements down the page here...

6 weeks is about normal for  advanced parole.

Regarding your visa it can be easier but it helps in my experience with others who have travelled with their new wife to foregin countries if she owns her own home in Kiev (you have said numerous times she is from Kiev and Elenas models), her age, bank accounts, her career status, children.

I see you did a K-1 and now are married so the additional paperwork I would send and how to contact the foreign embassy is a little different than K-3 but still should not be an issue.  I am not going to post to much more on this thread as the RWD police will be out.

Until your wife becomes a citizen (citizenship not Green Card) of the GoodOl'USA, you need to stay on your toes about her travels.

Not exactly true.

Once she receives her (Conditional) Resident Alien Card, there are many countries that have a more relaxed entry requirement.  canada, for example, will be as easy to go to as it is for an US citizen.  Western Europe, not as much.

A good resource is here on the Delat Airlines website: http://www.delta.com/planning_reservations/plan_flight/international_travel_information/visa_passport_information/

X633

I would like to add:

Look at your advance parole document closely. They can be good for one entry or multiple entries back into the US. If she travels outside te US more than once it needs to be a multiple entry advance parole.

As GOB said, check everything twice before she leaves. The problems dont come when you leave they occur when you re-enter.

I am not going to post to much more on this thread as the RWD police will be out.

Off topic, please forgive.

Ah, dont be scared. I recieved a ticket yesterday and i'm still alive.

I don't disagree with you ConnerVT, BUT....If you read what I said: "You need to stay on your toes".

That's all.

I didn't say: "She can't travel with a GC" (when she gets one).

Look, my RW goes to her citizenship interview next month (July), BUT...She still can't jump on an airplane with me right now and go to Italy (without a Schengen Visa).

In Europe, it doesn't mean Jack to them how close you are to your citizenship here in the GoodOl'USA.

She still needs to have that Blue Passport or a Schengen Visa.

When you travel, you always need to stay on your toes.

This is why it is best to give complete and accurate advice when responding in a thread.

Over the past six years, I have dealt with so many different situations for travel in and around the FSU.  Stepson in wife's passport, expired passports, minor non-US citizen traveling alone, Green card holder, AP holder, acquiring visa and travel for relatives, travel to countries outside the US, flights originating in and outside the US.

Every situation is different.  It is important to get the right information for the particular situation at hand.  One size fits all doesn't help, and can hurt.

The site I linked above is always a good place to start.

Another example of where your info was wrong:

Your wife still needs ALL of her visa's (Schengen, whatever) and her Ukrainian Passport to travel to overseas destinations (or Mexico/Canada).

No passport will be needed to enter/leave Canada, even under the new rules.  The only document either side will look at is her Permanant Resident Alien card.  Although I always recommend to everyone to own and carry a passport with them anytime they leave the country - even if it isn't a requirement.

A good example is a member who used to frequent here.  He was in the air during 9/11, and his flight had to put down in Canada after they closed the US air space.  Spent a couple of days there.  Imagine getting caught outside of your country without a passport?  Can't be good...

X633's wife is Ukrainian and cannot enter Canada with an Advance Parole and no GC (I don't think she even has a US drivers license?).

http://gocanada.about.com/od/canadatravelplanner/qt/drive_border.htm

They are ''recently married" and she has only been here maybe 8 weeks?

She needs a Canadian Visa to enter Canada.

Please do not give wrong information and confuse the man!

Thanks for all of the replies.  I realize that Advanced Parole is for reentering the USA. I am just trying to gain insight on whether visas to visit other countries are now easier to obtain with her being married and having USA address.

Again ConnerVT you need to read my post.

As you do mine.

My post explicitly stated Permanent Resident Alien Card is the only document needed for crossing the US/Canada border.  They would not even look/accept a passport from a FSU country, unless it contained a visa issued by the Canadian government (highly unlikely).

A Permanent Resident card is not an Advanced Parole document.

If you hand them a US Permanent Resident Alien card and an FSU passport, they will hand you back the passport, and say they don't want it.

Experience comes from living less than a 50 mile drive from one of New England's busiest Can-Am border crossings.

Hey X633.

My wife would tell you that in fact it is now more difficult for her to get a Schengen Visa than before coming to the GoodOl'USA.

I will explain.

I met my wife over 5 years ago in Greece.

Marina is Russian and of course she needed a Schengen Visa to meet me in Athens. Marina had a very good job and traveled quite a bit before meeting me, so she had several Schengen Visa's in her Russian passport.

She always booked these trips as "tours", traveling with a group of Russians.

She never had any problems.

Moving ahead, she arrived here in the GoodOl'USA and married GoodOlBoy and then decided that she would like to travel to Italy (Milan) to see a very close Russian girlfriend of hers who just had a beautiful baby girl.

We filed the appropriate documents, passport and monies here in Miami with the Italian Consulate General.

She was promptly refused the Schengen Visa!!

Needless to say, we were in shock.

After a lot of research, we found out that if she had "booked" a tour, with tickets and hotel reservations (like she use to do in Russia) she would have probably been approved.

I have heard it mentioned on RWD that there are other "easier" Schengen countries to visit, than Italy.

I have also heard it said on RWD that once you arrive at any Schengen Country you can drive inside all of the other Schengen countries (cross borders) with no problem, BUT......I can't comment on this aspect.

So when Marina gets her citizenship/passport this year, we are planning on going to Italy some time soon after.  8)

Problem is, unless you "parachute" her into Canada, they won't let you cross the border (without a GC) to "drop" her off.

Just head up near Montreal and take a boat across with the rest of the drug runners.  You can pay the Indian reservations up their about $100 to access their land and they will allow you to cross the St. Lawrence to Canada.  Will need to get your own boat.  On the Canadian side no one is there to check or cares to check.

I fish in November up there after dark and it is like a drug zone with police helicopters and boats flying across the river. Plus the ice flowing down the river which bangs into the boat, guide is usually on pot laced with acid, and your freezing even with the coast guard survivor suit.  Great fun.   :D

Case and point on watching these flights... This is from Kayak at the shopping mall above our picture.
DFW to Odessa less than $988 on Czeck Airlines--
Sounds pretty juicy until you  see that on the return you have an overnight flight with a 17 hr layover in Prague. [I've done one overnight in Vienna]  This is why we say watch the itenerary closely. Probably could get a Czeck visa in a week if you go to  a really hot passport office or you could just sit at the airport for 17 hours....that's really boring.
