Second K2 visa possible

For a while now, people have been saying that if a K2 child leaves the country without Advance Parole she/he will not be able to return.  The law says that a child may obtain a K2 anytime up to one year after the K1 is issued.  There is nothing stating that an earlier K2 precludes a new K2 as long as the year has not lapsed.

A new determination from the State Department's Bureau of Consular Affairs has affirmed this.  Unfortunately this affirmation came one day too late for the daughter of a friend of ours whose application for a second K2 had be turned down by Moscow Consulate.  Even congrressional inquiry failed to provode the consul to check with the BCA and it wasn't until the girls family appealed directly to the BCA did proper instruction go out to Moscow.  The embassy tried to get her a visa issued on the 365th day but she arrived at the embassy two hours too late (She lives in Siberia and was required to get new police reports and physical and fly to Moscow all on 48 hours notice).

The family is working on other options at present and the consul has asked BCA for a waiver of the time limit in this cases due to their error in denying her earlier.
