SSN , we were turned away

My lady came to America  3 months and  5 days ago  on a 3 month K1 visa , fiance visa , meaning  that we had 3 months to get married or she would have to return to Russia .
We were married   that the 2.5 month mark  , about 3 weeks ago .
Today  we went to  Social Security  office with all necessary   papers for her to get a SS  card  and were turned away because her visa had run out of time ,expired , I told them  it was a 3 month K1 visa for marriage  and we had the marriage certificate to show we were married , they said for us to go to DHS  and  talk to them about it .
Was the SS agent uninformed  ,
confused or did we miss  something?
Is she here illegally   now  or what ?
How do I get this cleared up ?

Ross,

  You were supposed to apply for the SSN as sson as possible after her arrival - BEFORE the wedding. Now
by current law, she cannot even apply until she has the first (Conditional) Green Card....

  All is not lost. She's perfectly legal, except to work. Find out what your state requires for her to secure
a Learner's Permit if she plans to learn how to drive...

Where can I find a list  that shows what documents we need to gather  for  a green card .
Info  that applies  to  our  situation  involving a green card .
I am searching the net for this info , however , I am hoping that someone already  had a handy link for such things .

  We applied for AOS (Adjustment of Status) in 2003 so I'm hesitant to give you any advice other than
to stick with the official website of Immigration Services. Any other place, including here at RWD - merits
a cross-check with current information as issued by BCIS...

  Dang - I neglected to welcome you here, so - WELCOME...

I should also have mentioned that as you begin to trudge through the small pile of paperwork
that Immigration requires and have questions, feel free to ask away...  those instructions are
not always crystal clear. Stay organized - and never, but never, throw anything related to you
and your wife away...  keep it all filed so you can locate it.

Hopefully some AMs (American Men) here who have recently filed AOS for that first GC (Green Card)
will step up to the plate and offer specific and current advice.

Congratulations to you and your new bride, and again, welcome.

I filed for my wife's AOS and she received her green card recently.  The Visa Journey website gives  step by step instructions on the paperwork.  I have also cut and pasted below a cover letter that was posted by HiTech in response to some of my own AOS questions.  I found his cover letter very helpful.  I rarely post so I do not know the best way to refer people to other threads.  If you search this forum on AOS questions and X633, you will find this thread.

Yeah...you kind of screwed the pooch on getting your wife's SS card.

But it will be OK.

As everybody else up thread had mentioned, check in and read the Visa Journey site.

When my wife came to the GoodOl' USA 4 years ago, we went down to the Social Security office in Miami 1 week after her arrival.

She received her SS card in the mail a few weeks later, (of course it was in her maiden name).

On the SS card it also stated in bold letters above her SSN something like: "Valid for work only with DHS authorization".

About a week or so after that, we flew out to Las Vegas and got married.

Any Newbies reading this thread.....When your fiancee arrives here, get down to the Social Security office ASAP and apply for her card.

We decided to wait till we got the marriage cert.  before we  applied for SS  , that set us over the 3 month visa limit  by 5 days .
We got married in Vegas ,too.


How long did it take her  to get permission  from DHS  to work?

Hello Ross.

I didn't forget about you, I just wanted to check with Marina about the timeline for your question (I wanted to be accurate).

It took us 6 weeks to get the Advance Parole and Employment Authorization after we filed all the documents and paid all the fees.

This was almost 4 years ago, so I don't know what the timelines are today.

I filed for my wife's AOS the first week of June and she received her EAD card and AP papers around the middle of July, then the AOS appointment letter a few days later for August the 20th.
I took her to get a s.s. card the week she arrived here but in our case it was useless to get a driver's license since our state requires the EAD card to get a learner's permit.

Do they still have that [what is it called ITN #?] from Internal Revenue.
We got that so I could declare Svetlana as a dependent for the yr 2000.
Or will that not work for employment?

I took her to get a s.s. card the week she arrived here but in our case it was useless to get a driver's license since our state requires the EAD card to get a learner's permit.

In NC, all that's required is a SS# - and being easier to obtain, maybe that's why
we have an inordinate number of illegal aliens driving around.

Regarding Advance Parole, we waited 4 months - got fed up with their unkept 60 day
promise, went down to the office and demanded it - just weeks before my wife's
flight was scheduled to depart. My feeling is every timeline stated is unique by
region, by office - and perhaps even by clerk. It's a crapshoot so it's best to keep
on top of individual processes - and hold them accountable to performance
standards - after all, you're paying their salaries.
