need help with the I-864 for AOS
« on: October 08, 2011, 12:02:11 PM »
hopefully some of you out there have done the AOS filing with a "Co-sponsor" because this is where most of my questions lay in "how to fill out this form using a co-sponser

Completely confused on how to fill out "PART3",  "PART5"  &  "PART7 question28"  (on the I-864 form)

the AOS is for my Russian wife and 11yr old Son.
we are using a co-sponsor (which is where  some of my confusion on how to fill out these sections)

"
PART3"
I assume I need check box 8 and the box YES and also check box 9 then list my wife's 11yr old son in the underneath section OR do we not check BOX9 and do not list the son because he will have a separate I-864 filed at the same time as his mother by me (sponsorand co-sponsor?
(
I am assuming I need fill this section out the same for both the “co-sponsor” and me (sponsor))

"
PART5"

on this part the questions have to do with  "How to fill this out for the co-sponsor"
for the co-sponsor on 21a do we put 2  (my wife and son), OR 1 (only wife because we do not list the son in PART3 because he will have his own separate I-864 filled by me and the co-sponsor OR 0 (zero) because neither one live with the co-sponsor???

"
PART7"
Question28 -ASSETS of PRINCIPAL SPONSOR IMMIGRANT

my wife's name is on both our checking and savings accounts do I list these as "assetsfor her even though they would be listed on the above "Question26" for ASSETS of SPONSOR?
and on the "CO-SPONORSI-864 are these assets listed on Question28 or left blank since these assets are accounted for in the  "Sponsor Assets" on the I-864 I will be filling?

any and all help will be appreciated
Thanks

side note I have been lookin on VJ for answers but did not find and also posted the same questions without any response from the members there

P.S if you can only address some and not all of my questions any little bit will help

Hey Chilli!

Good to see you posting and all is well. How long has it been posted on VJ without a response?

I'm confused. This is for your stepson AOS or your wife?

edit to add:
I see for them both. Can I ask why you are listing a co-sponsor?

Pt 7...

If your income, or the total income for you and your household, from line 24c exceeds the Federal Poverty Guidelines for your household size, YOU ARE NOT REQUIRED to complete this Part.
There is no 'co-sponsor' at least I never heard of one.

You are the sponsor and you are responsible.
Just list all the income from everywhere.

it is the AOS for the wife but the son is included since he came over at the same time and a second I-485 is filed for him (Cost is $695 for him).

there IS A co-sponor (see USCIS) IF you are under poverty level (which of course I am not) or if you cannot show "current" employment (which is my situation) then a "co-sponsor" is needed (family, friend, does not need to be related)

Do you have an income?

It doesn't matter that your wife is on the bank accounts with you. List them. In fact when she goes to her GC interview they will probably ask if you have joint accounts and it is favorable that you do.

On Part 3: You check #8 and Yes and then list the son appropriately
(I could be wrong, hopefully someone will chime in) I don't think you need to file separate AOS for the minor child.

Part 5
That section does not include your wife and son. That is your current household excluding those you are sponsoring. Keep in mind, do not count anyone twice.

Part 7
Again, makes no difference that your wife is listed on assets. They are yours and could become subjected for support "if needed". Do not count the assets twice
