Risks for Conditional Green Card

What are the risks to the man if his wife passes the AOS interview and gets the conditional green card and then divorces?

As I understand it, the conditional green card has an expiration date and two years after it is granted, the couple must jointly apply for the removal of conditions.  I understand the "affidavit of support" risks, but are there other risks?  Does having the green card make a difference during a divorce?

You might be accused of being part of fraud for not being in a genuine marraige if she got her green card and then immediately divorce afterward. But I think that would be difficult for the government to prove and waste of their time and money. I remember you were in a shaky marriage happiness. Have you made a deal with your wife to divorce after she receives her green card? If you two have decided to divorce and you stay married longer just to wait for her green card, she'll be entitled to a bigger piece of your pie. Keep that in mind.

There are knowledgable people here, we may be able to give better advice if you have more to tell.

The risk is simple: as soon as RW get her conditional green card ahe can divorce you. The she get X amount of money from you and hires a lawyer who helps her to apply in 3 months before the exparation of the conditional GC not from you both names, but only from herself. Even if she will be denied, she'll file a waiver... All together it will take quite a sometime, and if by that time it'll padd 5 years from the moment when her conditional GC was granted she will be able to apply for citizenship.
I don't think INS, or whatever they are called now will spend their time in accusing you in fraud marriage. If you got married in good faith and with the goal to build the family and can say it on the Bible, you are fine.

Yeah I think you're right.

I think anyone in doubt, considering marriage while still pondering risks, should wait until those thoughts disappear completely.

There are probably more than a few that will rationalize such thoughts thinking 'well.. even if all goes to sh!t I can still get a couple good years out of her', believing some kind of control possibility exist.

I believe most governments turn a deaf ear (rightly so) to those screaming 'SCAM' when a relationship ends, after all in the worst case scenario she will be spending his money locally, helping the domestic economy instead of spnding his disposable income overseas..  In the best case she might get a job and become a taxpayer herself.

Might as well make the best of it.

No, I'm not cutting a deal for marriage fraud but if I had to guess if she is totally committed to the marriage I would flip a coin to get the answer.  Sometimes I just really feel like a mule.  I guess the only way to find out is to wait for that laminated card to arrive in the mail...

Like the saying goes... "If you love her let her go.  If she comes back she is yours.  If she doesn't then you hunt her down..." (joking) ;)

It seems you're going to have a short painful ending or you're in for a long rollercoaster ride of a marriage. Unfortunately you have little control over your destiny and real happiness may never be known. Living in a loveless marriage is no way to live.
