Canceled K-1 visa question
« on: April 30, 2007, 02:00:17 AM »
A  friend is worried that he will have problems filing a K-1 visa again for his fiancee. They canceled the first time about 2 years ago due to some troubles she had with her family. Now they want to file again but they are worried that the previously canceled K-1 will be held against them in some way. Should they be concerned?

There are a couple of members here that can probably give you a good idea what to do and will chip in soon..  Unfortunately I'm not one of them  ;D

Did she come over the last time? I do not see the second filing for the same woman to be much of a problem. It may come up as part of the interview but the answer is an appropriate one.

What country is she from?

No, she did not actually come over as they stopped the process before it got that far. She is from Russia with 2 children. Thanks guys.

I have had a client that brought the same woman over 3 times. She entered 3 times. I have had about a dozen with the same woman ENTERING twice. IMBRA is not applicable to your case.

I do not see you having a problem with a second K for the same woman who did not enter on the first visa. Make sure that you are clear in your declaration
