Information Requested on I-751 Form For Child Only

Hello Everybody,

Sorry to just show up here on this forum when I need some help, but I wanted to ask some advise about filling out the I-751 Petition to Remove Conditions. Our daughter was not eligible to submit her application with my wife's original form, because her green card did not fall within the same 90 day expiration window as my wife's first green card.

I just want to make sure that Part 1 of this form has my wife's name and that the child is listed in Part 5. The form is filled out like it is my wife's application, only the child's information is present in Part 5, whereas it was blank in her original application.

Of course now we get to pay the $ 545.00 fee again. ::)

Please, if anyone has information or first-hand experience on who's is listed in the first part of this form, please post an answer. In one part of the instructions it says that the child applies, but in the Visa Journey forum, one poster writes that they filled the form out this way and it was returned. We are not sure what to do, and are not willing to trust the "information" line answered by the USCIS hired guns. Thanks.

Child's name and info goes in section 1
check "b." in section 2
fill out section 3
list all information about your wife (child's mother on whom child's residence is based) in section 4
and leave section five blank.

I'll update this thread after I receive word back on whether the application was accepted without problems or not, for future reference.

The check was cashed and we  received a case number and a notice in the mail.  So far so good.

Well, here is an update.  We had not received the fingerprint appointment date.  So, after a month or so passed my wife called the USCIS and asked why her daughter did not receive an appointment date.

A month or two went by and a notice came in the mail, saying "not to worry", she had already attended her fingerprint appointment. 

This was completely incorrect of course - she was only a nine year old child.

My wife called the USCIS again, and after a brief hour or two of holding the phone or talking with people who did not believe her - or who had a clue or what the real situation was - she finally talked to a real, live agent with complete file access.

My wife had to confirm that no, she was certain our nine year old did not get through the fingerprint appointment without her and that yes, she wanted to re-schedule.  So the agent gave my wife a valid case number.  So almost four months later we are still waiting. Hopefully, we will get the notice and everything will progress normally from there.  ::)

Go online and make an InfoPass appointment. We did that during the 2 year card process and they took sent us right over to the fingerprint area and it was done within 30 minutes.

Sometimes you have to give them a bigger push.
