 Hello all,
 I am currently in Ukraine and my g.f. and I are beginning to gather all our k-1 documents. My g.f. and I went to a translation agency yesterday and the lady said that her birth certificate may be no good as it is from Kazakhstan of the former USSR. The woman had not even seen the document,we were only there to find costs and information. She said that it may take 3 months to get the new birth certificate. Can anyone help who has some info on this?----- A little background------ She has lived in Ukraine for many years. Her father was in the military and she was born in Kazakhstan. Any advice would be helpful.  :cluebat:

For the initial petition for a K1 you do not need her birth certificate. It is not a required document for the USCIS. All documents must be translated. IE. Her divorce papers or certificate.

They will want the birth certificate at the embassy interview. Its not clear if you have one or not?

My advice is send the petition to the USCIS. While you are waiting (3-4 months) go to the Kasakhstan embassy in Ukraine and ask about the birth certificate. Also while you are there obtain a police certificate showing lack of criminal record for your fiancee if she lived in Kasak past the age of 16. You need a report for each country she lived in past the age of 16.

Have the documents translated for the interview.

My wife is Ukrainian, born in Soviet far East, Sakhalin Island.  We got her Soviet birth certificate translated and used it with no problems.  This was almost 10 years ago.  We celebrate our 10th anniversary in August.  She has been a U.S. citizen for several years now.

Don't rely on advice from a translation agency, in a foreign country, on what the USCIS/US Dept. of State will require for a USA visa.  Their job is to translate, and certify their translation is correct.  Period.

My wife was born in Azerbaijan, and she moved to Russia as a child.  We had her original birth certificate translated.  No issues.
