Does anyone know if at interview the interviewer just asks the question "how you met" and if "background info was received " to the fiance . Or do they ask for actual physical copy of something. Unfortuneatly agency failed to do check or present completed questionaire to fiance when we first started corresponding one year ago so now trying to catch up. Incorrect info from Agency when I inquired about this at time of first letter. Will be visiting for third time next month(Ukraine) so would like to recity it when there if possible

Have you filed for a visa yet? What country is your lady from?

I didn't meet my wife through an agency but rather through a newspaper ad. She is from Ukraine. When she went for her interview the first question he asked was how did you two meet. She pulled out a copy of the ad for him and that was the only question he asked.

If you haven't filed any paperwork yet you might consider running an ad and meeting all over again.

You might also consult with an immigration attorney. If I understand correctly the IMBRA requirements are directed at the agencies. If you acted in good faith and have copies of correspondence with them inquiring about their compliance and you have nothing to disclose I can't imagine there will be a problem.

Another option is to call the embassy and tell them the story and ask them how to proceed.

Or, you can marry her in her country and go the K-3 route instead. Then IMBRA doesn't apply to you at all (unless they've changed something).  Regardless of whether you do the K-1 or K-3, probably the best thing to do if you have and arrest or record (after consulting with an attorney of course), is to get a copy of your record and have it translated into Russian (or whatever official language is necessary) so she can present it at the interview showing that she knows everything about whatever past you have.

I think it applies to k3's as well. We did a k3 and they asked

Goto www.visajourney.com. All your questions will be answered there by folks who have ""been there and done that." IMBRA typically is used by agencies and marriage sites. More to protect the woman from guys who have a history of abuse. I met my gal while I was on vacation and this would not apply to me. It is only a box that is checked when you file for her visa along with maybe a small explaination that means much of nothing.

Agree with Viking

Dont work yourself into a frenzy by over thinking this IMBRA crap.

If you have a legitimant relationship and you meet the required criteria you have little to worry about.

My own opinion................it does not matter if you check the yes or no in the IMBRA section of the I-129.

Legitimant, no fruad, then you are set to go.

I think it is the agency or websites responsibility to gather the information on the client (you) and give to the women. If they did not gather the info not much you can do about it, as in saying you had no idea........so relax.

Thanks for advice from all. She is from Ukraine and no visas have been filed yet. Agency has since cooperated and is presenting her with completed questionaire and translated, and her okaying release of info. I have clean background.Yes, I was a little frenzied and appreciated the responses.

Given that I would go with the "honesty is the best policy" route. When and if the question is asked I would explain that the agency was not origionally in compliance and when you found out they were not at your insistance it was done as to comply with the law. I can't imagine a problem with that if you have nothing to disclose. You might want to consider being there for the interview though.
