Here is the scenerio, I filed her EAD back on October 4 and it was approved on January 24th.

Her approval letter was never received and was not reported to USCIS as undeliverable.

In essence immigration says I have to refile the 795 and pay the $180.00 again even though she has already been approved for her EAD. Does this make sense to you?

I think we have been screwed. My only alternative is to make an infopass appointment and print the approval confirmation page from the USCIS website. Maybe she will be issued her EAD at the immigration office.

This is the second time a notice was not delivered. I even had a member of the House of Representatives in my district intervene by sending an email to USCIS. And this is what the Rep's office told me, I must refile.

Can someone tell me what I can do to guarantee she will receive her EAD soon?

Why can't the immigration people send her another letter of approval? How difficult is this? Oh, I forget this is the US government.

 Sorry to hear about this. The level of incompetence at USCIS is only surpassed by their stupidity! I think that the InfoPass would be the way to go with this. Perhaps others would have different options for you. Good luck!

Ken, it only proves that our government doesn't give a damn about a Russian woman. If she were a Mexican woman it might be a different story. How many illegal Mexicans are here in the US?

Personally, I would like to see a huge amount of Russian people entering the US so Russian can become a second language and Spanish a third language.

I totally agree with you there! Elena is in advanced ESl classes right now and even the teacher has complained to the Spainsh speaking students there about their language skills (or lack thereof) and how they are doing thier work. We are heading for a country where Spanglish in the first language and English is only spoken in back alleys and dark basements.

Well it happend to us too.

He has to have his second set of fingerprints taken.

Even after I submitted proof of his first set. More time off from work and school.

 You are not the only one getting this kind of $hit from USCIS. We are again sending in "more evidence" for them regarding Sergei's AOS. This will be the third time we've sent information back to them (that they already have in quadruplicate!) to get this done.

 Ya just can't fix stoopid! (But is USCIS's case you can probably promote it to upper management...)

Wow SoC. I think you've been having problems with your mail since day one. I'm not trying to rub this in but just last week we went for the interview for the EAD and AOS, and in just today in the afternoon mail Val received her EAD card. Is that usual to get it so quick? Actually what we want is the AOS but I have a feeling that might take a bit longer. Tell me, we've been denied a SS card in the past, should we file again and try for it or just wait for AOS?

 Yes, that is pretty fast but there is truly no rhyme or reason to  the process. If I remember correctly (and you better check the  US(BS)CIS site but if you have the EAD they have to give you the SSN.  (Okay, no they don't HAVE to do anything being a govt. agency)

 Elena was sorry she didn't get a chance to talk to the boss today  but thinks the idea for the avatar is a good one! We're really looking  forward to the visit.

We went through this on Liliya's first AP as well. We did the infopass thing and when we got there, we were told "You can wait for it to get sorted out, or you can pay another fee and walk out of here with it today - the original fee is just gone, probably best to forget about it." Renewals for EAD and AP have been much faster than initial filings for us, but it's a small consolation....

SoC ~ looking at the timelines for Baltimore, you might just want to wait until April when you should be getting her AOS interview.  If all goes well, you won't need the EAD card.

START2 ~ she was entitled to a SSN while she was a K-1, but now you will have to wait until her AOS as she is no longer has that status.

Actually the timeline for processing the I-485 (AOS) in Baltimore is December 20, 2004. I filed October 6, 2005. Sounds like her interview will be in 10 months or more.

I wrote to my Senator on Friday and she specializes in dealing with government agencies.

I think this whole process is the luck of the draw and where you are living.

Her girlfriend in NYC has her interview already scheduled for May and the processing dates for NYC are 2003?

I have good news. We found Iryna's EAD among some old mail. It was never opened. She was throwing out some papers and junk mail and noticed the envelope addressed to her. I opened it and we were both very surprised.

We reached an agreement that I see all her mail before she throws anything away.

I am glad we went through the old mail because the envelope looks nothing like the regular mail we receive from USCIS. It was in a blank envelope and looked like a bill.

The postmark date and Missouri return address tipped me off.

Looks like we may receive the AOS interview in April (180 days after filing) if the letter is sent timely and we both see the envelope.

Are we really comparing apples to apples above???  It makes no sense to me so I believe it is a different situation / type of visa than a Russian woman comming to the USA on a K-1, getting married within the 90 days and filing within the 90 day period (I know this does not have to be done / could be after the 90 day window without problem) for AOS etc.  Therefore, I suggest your facts are probably wrong or you are comparing different visas.  Another thing could be your NYC girlfriend is lying about her status, which is very common.  I'll believe it when I see it........................:)

Bruce, her girlfriend's husband filed after me and I filed October 6.

If you look at the USCIS website it is saying processing time is taking between 120 - 180 days. Then if you look further at processing times at the various District Offices, they are way behind the 120 - 180 day estimate.

Maybe her girlfriend is confusing her EAD with the green card.

EAD is usually approved within 90 days, the same for I-131.  AOS varies greatly between regions of the countries and centers.  I suppose it is possible for individual cases varying, even comparing apples to apples, but it would take someone on the inside pulling for a particular individual / putting their name to the top of the pile etc. which is unlikely.

ROTF !!! After all the moaning about USPS and "those idiots" at US(BS)CIS....wasn't it those sleazy 8mm film companies used to send their wares in plain brown wrappers?

I'm tickled you found it, actually. We had very good luck recently - we filed I-751 Removal of Conditions on 16 February, and just received two separate notices that both my wife's and stepdaughter's green cards are extended another year, or at least until they come up with a decision or an interview date. The extension was key to our summer trip to Russia - during which time their existing 2-yr cards would have been expired. One more hurdle cleared. Now watch them schedule an interview while we're overseas! (Maybe Clyde, Ken or Jet could stand in for us?)
