I-485 interview
« on: October 23, 2006, 07:59:27 PM »
Hi all -

We recently received a NOA setting our interview date for their adjustment of status on November 20th.

So... I've seen "Green Card" and guess this is suppose to be some type of "Are they really married?" interview.  What should we expect?  Will it help when we bring our newborn daughter who will be all of 5 weeks old?  Anything special we need to bring?

Is it even possible we could fail this interview, and if so, what would happen?  It seems silly to even consider - we are legally married, have lived together since getting married, I like her borsch, she occassionally likes my peanut butter and jelly sandwiches.  What do we have to prove?

Kevin,
go to page 2 and look at my post that says Green Card. This should give you some idea. Good luck.

Go to visajourney.com for a wealth of information including sample questions they will ask.  We had our interview three weeks ago and the green card arrived this week.  Bring photos of your life together as well as all the papers they request and copies of everything you submitted up to this point. (they didn't have the orginal I-129F paperwork at our interview)

Kevin,

Son of Clyde asked much the same questions some
time back, and I told him "Unless your stepson hops
up on the examiner's desk and hangs a moon, you
should have no problems....

You got it right - prove the validity of the marriage,
and all's well. Your darling baby should seal the deal !!

Best wishes, Vaughn

Children born of the marriage are considered an automatic pass of the interview. If you have to score a 70 to pass, a child is a 70.

The burden is on the alien and petitioner to prove a shared life. Nothing is more definitive of a shared life together than a child of the union. . . .

WHen my exwife and I went to interview back in 93 with our son, the fact that he began shredding the file that he yanked out of our interviewer's hands merely got us sent out of the office for an hour while he approved her application and took a break.

They hate it when you bring children. . . . .

Thanks for the feedback!

Just a status update:  Yesterday, January 9th, we received another NOA welcoming my ladies to the country and indicating their cards would arrive in a few weeks.  Oddly, I receive SIX e-mails containing the same information on the same day the paper letters arrived.

I wonder if the I-797 (NOA) is sufficient to get some basic things started, like getting the 11 year old a SSN?

Kevin,

My stepson had a SSN before the interview, you will have no problem now. Maybe it was easier for me because I had filed for a work permit and my stepson was 15 at the time.

I had a few problems because I could not add him on my income tax return. I had filed for an SSN and he needed a taxpayer ID or SSN. I decided to wait for the SSN and amend the return.

If you want to claim your child for tax purposes and don't have or can't get a SSN yet, you need to contact the Internal Revenue Service for Form W-7,  Application For An Individual Taxpayer Identification Number

Congrats, Kevin! Receipt of the GC's is akin to the woman and child
achieving "person" status. You and little Nastya could waltz into SSA and walk out with a receipt indicating her SS Card will arrive in 10 days or so. The Green Card opens doors.

And now the Removal of Conditions Clock begins to Tick...
