Can you send KEV-1 when the Embassy has not acknowledged receipt of your petition? Are you not putting the cart before the horse?

 I thought she was to send it herself by fax or email. If I knew this I could have sent it on behalf of my girl 2 weeks ago. I hope you have her signature on KEV-1.

I was reading the instructions noting that she must have everything in her posession that is on the checklist and relates to her case, I assume this is what your attorney mailed in January.

The Embassy is making it very difficult for the woman by having her submit original documents, photocopies, a second passport photo and more translations. I'm glad I sent her my translations. Now she needs to have the police report translated on her own or emailed to me to have me take care of it.

It seems the Embassy likes to test our tolerance level.

Anyone can send the KEV-1 form to embassy. Packet 3 is the only notification that they have received all the documentation. If you read KEV-1 instructions, you can actually mail the KEV-1 form to a site in the US, if mailing from the US. Also, on the downloadable version, there is no line to sign name, and they say on web site that the downloadable KEV-1 form can be used. And in the instructions in the downloadable packet 3 (KEV-1 instructions) there is no mention of signing form, just filling it out and emailing it back. On the visa section of web site it does mention signing, but that is also an older page, and may not have been updated. I have sent it in to the embassy and according to web site if it is not complete, they will email us back. I have sent my fiancee a scanned version, so she can quicly print it up, copy it to form sign it and send to embassy if not correct.

Here are the instructions in packet 3. No mention of signing form. Quite confusing to say the least!

NEW REQUIREMENTS FOR POLICE CERTIFICATES

All police records issued after November 1, 2004 for K visa applicants who have changed their names need to bear all the names applicants have used. These include maiden names and names from previous marriages. If the name was obtained not through marriage or divorce, it should be listed on the police certificate as well. The certificates issued only under the applicant's current name will no longer be accepted.

The Consular Section would like to remind you that if you are aware of any discrepancies in the spelling of applicant's names or dates of birth, or in cases when not all of the applicant's last names were included in the petition at the time of filing, please notify the Consulate of these discrepancies. It is the responsibility of both petitioner and beneficiary to keep the Consulate informed.  Failure to do so prior to the visa interview will lead to delay in visa processing. The corrections should be faxed or e-mailed to us.

 

FIRST: Obtain all the applicable documents on the checklist. Supporting documents from your American fiancé(e)/husband must be sent directly to you so that you may present them during your visa interview.  As you obtain each document, check the box for each item. DO NOT send any documents except KEV-1 form to the consular office.  Send in KEV-1 only when you have in your possession all of the documents relating to your case. Do NOT send KEV-1 form by registered mail.

SECOND: WHEN YOU HAVE OBTAINED ALL OF THE DOCUMENTS that apply to your case, carefully read the statement at the bottom of KEV-1, and send the form to the American Consular Section in Kiev. You will not be scheduled for an appointment until you return this checklist, KEV-1.

THIRD: You may send KEV-1 to the Consular Section via mail, e-mail or fax. The consular office cannot schedule your appointment until this form is received.  Please, note that the fastest way to schedule an appointment is to e-mail KEV-1 form as a scanned attachment.

Note: If you fail to return fully complete KEV-1 form (i.e. without appropriate marks indicating that you have necessary documents) you will have to resend it and your process will be delayed.

Your final interview will be scheduled as soon as possible under the US legislation and depending on our workload. The total fee for EACH K VISA APPLICANT (including children) is $100 USD payable in US cash only.

 

You need not check with the American Consular Section in Kiev, Ukraine unless you have to report a CHANGE OF ADDRESS, mistakes in spelling of your name or last name, or change in your situation such as marriage, death of petitioner, or birth of children. Please do not send any documents to the Consular Section in Kiev unless you are specifically requested to do so.

 

FOURTH: Once you send us this form indicating that you have all the documents, we will schedule your appointment. We will NOTIFY ALL THE APPLICANTS by e-mail or mail about the date of the interview. Those who submit their KEV-1 forms by e-mail will also receive notification of their interview appointment date by e-mail.

 

If you cancel your visa appointment, we will have to reschedule it for another date. Given workload constraint this might be 4-6 weeks after the date you notify us of the cancellation.  We can only reschedule your interview when we receive a written statement from you asking for a new interview date.

It is your responsibility to keep the Consular Office informed of your current address at all times.  If your address changes, please, notify us by fax or e-mail.

SIXTH: When you arrive for the interview, you MUST present all the original documents accompanied by a photocopy and an English translation, which is either notarized or produced by a certified translator.  After the interview all originals except police certificates and the medical examination report will be returned to you.

SEVENTH: The medical examination is not required to schedule an appointment. However, all K visa applicants must present the medical examination during the visa interview, otherwise a visa cannot be issued.

EIGHTH: [size=If you are an attorney of record, please note that an original set of documents will be sent simultaneously to the beneficiary.][/size] [size=][/size]

NINTH: As of June 1, 2004 the Consular Section uses FedEx delivery services to return passports to K visa recipients. Passports are longer returned at the Consular Section. Following the interview, visa recipients should proceed to the FedEx representative located in the waiting room of the Consular Section to arrange for the return of their passports with issued visas.  The cost for this service (delivery fee and insurance) is USD 8.00.  The Consular Section recommends delivery to recipients' usual address.  However, visa recipients may choose to have the passport sent to another address in Ukraine. FedEx will deliver passports to recipients within 24 to 48 hours. Please, note that no exception will be made.  The Consulate strongly encourages you not to make any travel arrangements prior to obtaining a visa.
