IMBRA K-1 application limit

I understand that IMBRA has established a lifetime limit of two K-1 "approved applications" for an American (with no grandfather clause for applications prior to the legislation).  What if the AM were to meet a foreign lady through an internet matchmaking "personals" website -- would the IMBRA K-1 visa limit still apply, or does this only apply to "marriage broker agencies"?

From what I have read, the limit is 2 either way. The lawyers on this forum are much better versed on this law. Just another stupid rule by our goverment. There is no limit on K3 visas, so one could get married outside of the country as often as they wish, and then file for a K3.

Sideskraft,

The "lifetime limit of two" applies to all K-1s regardless of how you met her.

Don't worry:

-  If you were on your third K-1, you would need to obtain a waiver.  I have heard that, so far, BCIS has granted waivers unless the petitioner has a criminal record, etc.

-  Most men would probably give up if they failed with the first two attempts.

-  You can always marry her in her country and file a K-3.

K-1 is still a better route than K-3.  If she has a child who will be over 18 but under 21 only the fiancee visa will allow her child to immigrate with his/her mother.  You also get to learn a lot more about each other before the marriage under the K-1..police and health checks as well as prior marriages are all disclosed as part of the process.  And K-1 costs less in fees and time you have to spend in her country.  If you've been marriage before, it's a hassle to get apostilled documents. 

If waivers are granted freely where there is not criminal record, then IMBRA seems like it would not be an impediment at all.  IMBRA assumes all American men are bad guys but then you have to look at the people who wrote the bill and got it passed without hearings. There were feminists working for non-profit shelters like AYUDA who protect "immigrant" (aka illegal alien) women from their naturalized US citizen husbands and boyfriends.

1) IMBRA applies equally to American women doing K-1s for foreign fiances.

2) Not all immigrant women requiring protection from their US citizen husbands (naturalized or born here) and boyfriends are here illegally. And even people (women or men) who are here illegally have some rights. No one, regardless of immigration status, deserves what I've had to photograph, document in medical charts, or testify to in court.

This limitation actually applies to all K visas (K-1 and K-3).  If you get one K visa approved, you have to wait 2 years from the date of the first K visa approval to get another K visa approved.  The limit is 2 in 10 years.  After 10 years, you can try again.  Waivers are granted so if a relationship fails, then have this visa taken off your "record" as soon as possible.

The way around this is to marry in her country and apply using a CR-1.  There is no limitation to a CR-1.

I am on my sixth K1 and it was readily approved without comment or request for evidence. But then- these are over the course of 17 years. . . .

Not sure but could have been because the guy hired a lawyer and gave him an e-mail from her saying that she changed her mind and wasn't coming to the USA to be his fiancee/wife.

I succeeded without retaining an attorney and without any evidence.

Yes I hear they are very easy to get if you apply.  I think it is just another way of checking out the guy and girl, to see if anyone is scamming someone else.
