Transfer of AOS packet
« on: August 29, 2005, 11:44:21 AM »
We just received a I-797C.  The notice date is August 22, 2005.  Here is what it said:

Notice Type:  Transfer Notice

This is to advise you that in order to speed processing we have transferred the above case to the following INS officefor processing:

California Service Center, 2nd Flr, 24000 Avila Road, Laguna Niguel, CA 92607-0111

That office will notify you of the decision made on the application or petition.  Any further inquiries should be made to that office.

Now, the CA service center lists April 1, 2005 as their date for processing which is much faster than the NYC service center.  Correct me if I am wrong but I assume we are being processed as if we were in the CA region and they just received us on August 22, 2005 - so we have a while to go yet, albeit much faster than the NYC office.   I wonder if our interview will now have to take place in CA?   I hope not because that would really take us out of our way for something that should be done locally.

By the way, this notice of action came from:

National Benefits Center

BCIS-DHS

P.O. Box #7216

Chicago, IL  60680-7216

800-375-5283

There seems to be a lot of this going on lately - and in nearly all cases, it appears to be good news.  NY is probably the worse DO for processing I-485s - to the point where some people have gotten green cards without interviews as a way of removing their terrible backlog.

There has been alot of talk about steps the USCIS needs to take in order to eliminate the backlog, one has been to issue the conditional GC without an interview, and the other seems to be this transfer to the CSC.

Your 8/22/05 notice date will have little to do with their posted processing dates, and from other reports, you should receive a 2-yr GC reasonably soon.

Good luck!

Well, I managed to get through to speak to someone at the BCINS.   Her answer to me was that the BCINS is trying to speed up the processing for the heaviest centers (NYC is the heaviest) by sending them to the CA service center which for some reason is much lighter, at least for AOS applications (currently on April 1, 2005).  Once they bless it in CA they would supposedly send the packet back to NYC where the interview would take place.  Luckily, I will not have to fly with my wife to CA for an interview.  I still have to go by the NYC I-485 processing time on the BCINS board but this transfer to CA should supposedly speed things up for me.  The NYC Center I-485 board shows they are currently processing December 16, 2002 so my late November 2004 has a long way until they get to me.

Racer X - I hope you are right.
