Expired I-192F, No Interview

Hi All,

It's been a wild summer here.  My fiance bailed out 20 days before her interview because of family problems.  Now that the family problems are resolved, we want to bring her to America.  However, our NOA2 expired 6/28/09.  Is there a way to restart that process or must I refile and wait again?

Sorry Darren, BUT....This is NOT a good sign.

I sincerely hope that the woman you are pursuing is in love with you as much as you are with her??

My wife would have NEVER cancelled her interview, even if her parents were sick.

She would have been on that plane from Siberia to Moscow crying all the way, but miss that interview over 4 years ago....NO WAY!! 

Now that the family problems are resolved...........

Look guy, I have seen everything in the last 4 years of marriage to my RW, sick parents, injured BIL, dying cat, blah, blah, blah.... you name it.

If my wife had ever fled or cancelled out her citizenship plans for any of this, it would have raised SERIOUS questions in my mind.

I am just trying to tell you that you deserve someone who puts you and your relationship #1 in her world and nothing less.

BTW....She could have gone to that interview.

She has plenty of time after she gets her K1 Visa from Moscow, to come to the GoodOl' USA.

I'm going to stick my neck out and say "How are you so sure about that?"

None of us know what troubles this woman faced last spring. I personally know one woman whose
father passed away post-interview but pre-departure. She called my friend to apologize for the
unexpected delay - and arrived a full 2 months later than originally planned.

The fact that dgellis's lady encountered trouble just prior to the interview smacks of a bailout
for other than "family troubles" - but let's give them the benefit of any doubt since he's asking
specifically for advice regarding a continuance.

Darren, I checked your Visajourney timeline - 180 days total NOA1 to Interview. Vermont Service Center.
Interview Date was 18 May 2009. Question - did she no-show, or did she notify them? Did she attempt
to reschedule? In any case, I wouldn't hesitate to contact the Embassy - make an inquiry before assuming
the worst. And the worst isn't too bad - another six months of repeated process - miniscule compared to
the lifetime you both want together.

Being married to a RW, I am kind of surprised you would ask this question Vaughn.

The Russian and Ukrainian women I have come in contact with over the years have one common (distinguishable) trait......they are like soldiers going into battle.  8)

Once they commit to something there is absolutely NO stopping them.

Sorry Vaughn, but I really think Darren might have a BIG red flag here.

BTW........A prime example of RW's determination would be Sculpto's girl.

Remember Vaughn......her Father was on his dying bed and she left him and came to Moscow to meet Sculpto for a "holiday" and then went home and her Father almost immediately passed away.

RW are "hardwired" to be this way....they are like tanks....there is NO stopping them, once they make their minds up to do something.

Thanks for the frank advice.  I, too, am mulling these same questions.

Are there programs/rules for continuances?

There is little risk in finding out what my options are.

Oh, in that case you are back to square 1, with a helluva' a lot of questions in the future (if you ever decide to refile).

Just curious Darren.

When you contacted the American Embassy in Moscow, (20 days before the interview) what excuse did you give them for cancelling your fiancee's interview?

Then there is zero chance of continuance. You're back to Square One as GOB stated.

I simply emailed the Moscow embassy and said that our engagement has ended and she will not attend her interview.

Was that a cover statement - or did your engagement actually end?

Do they BOTH really want it or just Darren?

Only Darren and his lady know for sure.

I had an incident with a GCG a long time ago from Brazil. I spoke with the embassy to cancell all paperwork. Then about a year later I got a letter in the mail that the case was still open. I had to send a notarized letter stating what happened.

 You might call USCIS and check and see if the case is still open just to make sure. You may get lucky.

Please let me disagree.
If you are looking for a traditional woman - you should expect that she will put her family before the fiance. Once a man becomes husband - he will be treated differently, but while they aren't yet married - parents always come first. Several of my friends had called off weddings for a year if shortly before weddings their mom or dead died, in some cases - the weddings were postponed for a year if a grandparent died. Sometimes - the wedding plans are adjusted to make it happen sooner - if there is an anticipation of death of a sick family member - if the young couple cannot wait (if a woman is pregnant) or there are some other considerations, and at the same time - the wedding cannot happen during the year following the death of family member. Then this young couple tries to get married fast, before the relative dies.

I would even go as far as saying that each of us may have several wives or husbands over the course of life, but we are given only one mother, and only one father. If woman goes like soldier to the visa interview while her parents are sick or are passing away in the hospital - who can guarantee that she will not leave behind her husband, or her children same way - if she will need to promote her social/financial status. I think you are hugely confusing the important issues, GoodOldBoy.
I would not think that Sculpto's girl is a proper example - we do not know her situation exactly, and we definitely should not be discussing her dead father on this topic. Let me just say that some diseases - like cancer - are lasting for years, and it is not clear how many days or months are left for person to live. Then relatives are getting used to the idea that this person may die soon, but they still have to go on with their lives. Maybe this was the case of Sculpto's girl and her father. Then - I am not sure it is a good idea to take a girl who is literally on the emotional edge, while her father is dying, and rationalize her behavior and then extrapolate this example to the female population of the whole country. People do the most unusual and crazy things when they are subjected to the extreme emotional states, such as depression or anxiety caused by disease or death of closest relatives. It is very wrong to assume that their behavior in such conditions is typical for these particular people, or to all people in general.

Hey all,

USCIS said contact the US Embassy.
I sent them email which they returned 9 days later stating that I must file a new I-129F.
Lydia called the embassy in Moscow.  The US Embassy told her that I had to send a letter on paper.  I did so.
She sent the letter to the Embassy via DHL.
She called several times, paid each time, finally was told that we must start completely over with a new I-129F.

At this point, I think it will be best to simply do as they say.  I have read that consular officers do have the right to extend the I-129F date, clearly they did not do so.  I went to the local USCIS office and the woman there looked up my receipt number and said that the last action on it was approval.  NVC referred me to the embassy.

So, after 3 weeks of runaround from all 3 government agencies, I must refile.

Oh huzzah.  Another 100 day wait for USCIS to discover that Lydia's background has not changed since the last time they looked her up.  Oh well.

If I can't stand the heat, I probably shouldn't be in this kitchen.  So, I'm shutting up now and tolerating the heat.
