Delay for OVIR "exit visa"

Hello,

Last but not least, my wife must get a paper from OVIR attesting that she can leave Ukraine. It is including the fact that her ex allows her to bring her son to live outside the country, etc. Do other forum members knows the average time to get this paper for Kiev ?She will have all requested papers next week... and finally because of this , we will have to wait march to be together... :wallbash:

I can't answer your question, docetae, but I am sorry to hear about yet another delay for you  :(

This *used to* be a significant issue, but I have not heard of as a problem for MANY years now.

But as I wrote, I have not heard of anyone needing the visa for a VERY long time, and my wife certainly did NOT need one.

It was in the letter sent by the embassy as requirement for Ukraine.
After going to OVIR, she was told she must bring:

- certificates of births (her and son)
- certificate of wedding
- certificates of divorced
- permission from  ex that son can go for permanent life out of Ukraine
- permissions from ex that I can go for permanent life out of Ukraine
- photos
-passports
- money
Everything must be with notary stamps

This is a little bit surrealistic (about permission from ex...)

The part about permission from the ex for the child to depart Ukraine *is* something I have heard about recently. In fact, it is becoming MORE commonplace.

Most nations are increasing vigilance and enforcement over child custody matters. Not sure if you all in Canada were inundated with the David Goldman case as we were here in the US (ref: http://today.msnbc.msn.com/id/34601024/), but it was a VERY high profile case in which a child was taken to Brazil by the Brazilian wife, who then kept the child in Brazil - remarried - and then died - leaving the child in the care of his step-father and his family. They refused to allow the child to return to his natural father in the US, and it took years of legal and political wrangling to finally resolve this past December.

How old is the child?

Does your wife have a court order granting her full/sole legal custody? If so, she may be able to use that alone.

BTW - nothing in the list you posted relates to the old PMZh (exit) visa/stamp. That was a holdover from the Communist era in which they held very tight control over the movement of their citizenry - even those living outside their national borders.

I have more detail today. This is paper from ex telling that they have no common debts. But all these papers (our certificate of wedding, her certificate of divorce, etc) must be brought to OVIR that will issue one document. Perhaps this is a new requirement, I don't know.

Child is 13 years old and she has legal custody. Exit visa is not the name of this document. it was her wording. She was told about this paper in the letter from Candian embassy telling her that permanent visa was granted and OVIR confirmed.

I try to find out delay from OVIR in order to buy plane tickets as nobody wanted to told her about in OVIR.
