Tourist and student Visas
« on: February 09, 2010, 08:42:02 AM »
I have sometimes wondered if the men of RWD would be so quick to marry if it was not a necessary part of the K-1 package.  I have a feeling that if we could bring RW here on a tourist visa and let them stay as long as we wanted if men would spend more time getting to know thier ladies before jumping into marriage.

Great question. Is there not possibilty of a RW comign over on a student or tourist Visa. That is definitely a concern. Living with someone for three months is hardly much time at all.
Heck, that is what we call the honeymoon stage in the dating scene over here. Is it just nearly impossible for a RW to come over for 6 months or a year so you can become better acquanted?

I mean, I would be more than happy to pay for school just so we could get to know each other better.

I would not say its impossible, however as it is misuse of the visa for immigration purposes it would be frowned upon, and if during the application there is any hint of the objective being to try living together the visa would probably be denied in a hurry.

It would be more useful to start a movement to get equality between married and not-married couples in citizenship rights, as is present in a number of European countries.
This would make it possible to form a family, including all obligations of support but without the obligations which are common in divorce.
No it is not a dog. Its really how I look.  ;)

The same goes for work Visas I assume? Anything is possible if a RW gets a sponsor (American work sponsor I am talking :) but is more difficult? The job must not be able to be filled by an American I assume?

Is there preferential treatment given to citizens of certain countries over others?

No one is holding a gun to anybody's head.
The visa [after it is issued] is good for entry until [I believe] six months. It is easier for you to go to their country and stay a while.
If we have any members that have re- petitioned for a lady, I don't think they are presently active on the board.
I do believe this can be done until a decision is reached.

Unless she's really a student the odds are unlikely she can get a student visa unless you're going to pop to prepay her tuition, room and board at a school where she has been accepted. Even then she's going to have questions about motivation and source of the funds which may prove embarrassing if she answers incorrectly. If she's a student and not in her last year of university she could possibly get here on a work and travel visa for the summer if you moved very quick and even then you wouldn't know where her work assignment would be. Cost for that program is somewhere between $750 and $1000.

No matter what anyone tells you, a percentage of people who apply for tourist visas are denied every day at ACS in Kyiv. Her travel record, age, employment, financial situation and performance during the interview are subject to scrutiny by the interviewing officer and if she trips their wires, she'll be grilled. The officers over there are not as stupid as some hope. They've seen their share of GCG, scammers and those thinking they can just get there and go underground. Maybe she will make it, maybe she won't. There are women who are married to US citizens who fail to get the visa so consider how your gal's application will look in the eye of a consular officer who may or may not be having a good day.

As is mentioned above, this is basically fraud you're inquiring about.

Had not even looked at it that way...
Thought we could kill two birds with one stone and further her education/work experience. Good point though  :(

Tourist visas are getting easier to get but there are still many turned down.

It is visa fraud to bring a woman here under false pretenses but I am sure it happens.  One other factor to keep in mind is that it could raise suspicions if you tried a few things that were turned down.  In other words lets say you tried for a tourist visa and it was turned down and then you tried a student visa and for whatever reason it was turned down, it might then raise some suspicions if you tried a K-1.

TFCrew was correct.  When a K-1 visa is issued she has 180 days to enter the country and then 90 days to marry or return.  Also that is 180 days and 90 days not 6 months and 3 months which a few people get confused about.

if everybody had cohabitation visa rules like belgium does, everyone would still get married anyway. Cuz this visa requires u to be at least 21, and prove to be in a relationship for at least 2 years. Almost no one waits 2 years to get together, so everyone would get married anyway :P Fiance visa doesnt have silly rules like that, i wonder why that is? They are making you get married here basically, cuz that visa is a lot easier to get, i read about tons of people getting denied cohabitation visa, but not fiance visa

Keep in mind that a RW entering on a student visa must take a normal load of classes and do well.

The wives of Simoni and KenC first entered America as students, and had met both men before applying for a student visa.

I have met several RW-AM couples where the RW first entered America as a student and later met her AM husband.

One option that should fly is for a RW to come to America to take formal and intensive English lessons.  The English Language Insititute at University of South Florida has some RW in it. The program is designed to enable the student to pass the TOEFL.  One RW is married and her RM husband remains in Russia, and my guess is that they are trying to make their way to America eventually.
