Submit I-130 before marriage?
« on: October 23, 2010, 08:19:41 PM »
I'm getting married in less than 3 months (Jan. 15th), and I see the wait times for I-130 is about 5 months.  Can I submit this now, before the marriage, in order to speed things up?

Part of submitting the I-130 is sending in a copy of a marriage license.
To send in now and send a marriage license later dated afterwards would not be a good thing.
It would also mean you lied on your forms claiming someone to be a spouse who was not at time of filing. Sure way to make sure your lady never makes it into the country.
Highly not recommended.

The marriage "license" is surrendered to the minister or official performing the ceremony.

The document to submit with I-130 is the marriage certificate...  while you're at it,
order an extra "officially sealed" document or two as backups.

Sorry, superbb - you're going to have to wait to file the I-130.

BTW ~ Congratulations. I assume your future wife just arrived ? Whooops - nope, I just
realized you two are planning a Kyiv wedding....  Enjoy yourselves !!

The ZAGS sets the date for your wedding.  I don't know about Kyiv, but in Simferopol the waiting time is several months.  Suggest you have your Fiancee check into this.
