K-1 Visa petition withdrawal process?

Hello folks,

Was wondering if anyone here could possibly share an experience or provide some direction as to what the process would be for withdrawing a K-1 visa petition?  It's still in the initial stage...probably a month away from receiving the NOA2. (NOA1 received Nov. 7th 2010)

but I would read up on the USCIS website?

A good place for visa information is visajourney.com
you would certainly find some members with experience in this situation there,and some good feedback.

still ultimately  I would advise reading the exact details of such a process , directly from the source, the USCIS.
you filed with them, so seems best follow whatever instructions they have for withdrawel?

 I've *heard* it is as simple as a  letter to the USCIS, from the petitioner, to withdraw the petition, with all the petitioners info, and the case number for ID. ( i wouldn't know if it need be notorized)
but i would not rely on that info ,and would go straight to the source and ask.

if you can't find it on thier website, then call.
The 800 line isnt the actual USCIS workers , but if you insist they enhance your call to a real USCIS worker ,
it's my understanding they will do so. Although its thier job to deflect you, simply insist.

I had to pull the plug on one back in 2004 that was already in Moscow, and I did it just the way you were advised here, by notarized letter.

You need to raise specific points:

1.  That you no longer love her and do not intend to marry her.
2.  That you do not intend to support her.

It worked for me.  The consulate sent me a letter about 6 months later acknowledging the withdrawl.

I withdrew a petition 6 weeks after submitting it.  I wrote,  "She had a change of heart.  End of story."   She really did.  Then a year later I married the wrong woman, somone who I had known long before the woman who had a change of heart.  :(

I sent my withdrawal as certified mail.  Of course your fees will not be refunded. 

Potential Issue:  I do not know if this qualifies as one of your two lifetime K-1s under IMBRA regulations.

I withdrew one as well and did about the same as everyone here said.  There is a lot of information on VisaJourney so it would be a good resource for you.  Basically I just sent a certified letter telling them that I wished to withdraw the petiton. 

It has been a while since I read the IMBRA regulations but I do recall wording somewhere to the effect that it covers a K-1 applied for no matter if it was approved or not.  I don't recall if that was for the lifetime limit or for the waver.  I do recall that it covered the waver for sure.  So if you apply for another K-1 within two years you will need a waver but that is no big deal, or hasn't been yet.
