A few weeks ago on Febuary 11th I thinking about Golden25's situation and the thought came to me that what he could use was some publicity. His Russian wife leaving behind her diary with it's diabolical plot would make for a good news story. Minutes later I arrive at my business where I have this PC.

I have this message from Elena Garrett of http://www.Russian-Detective.com sent to me at the exact same time I had the above thought. Strange....

So I contacted him and put him in touch with Gary "Golden25" of Iowa. It clicked. I will let Gary tell you how it went.

Afterwards I sent the producer a letter explaining the contributing causes to using false allegations to secure a Green card and certain issues that may touch a nerve with the public. Here it is.

I consider this letter very important. I have been thinking about what about what I was going to write for the past several days. I will get right to the most important issues.
 
It is my observation and that of others I have talked to that most people do not care about what happens to the men caught in these false DV situations. The usual reaction when informed of this situation is to think that it is strange that men would purposely go to another country to find a wife. They usually are suspicious of the motives behind this. When they are made aware that these men are accused of DV by their foreign wives they are also suspicious of what really went on behind closed doors. Also patriotism and feminism are factors that can influence their lack of sympathy towards these men.
 
This past Monday I talked with an immigration attorney in Rochester, Minnesota (I'm in Minneapolis) about this issue. She said what I had already come to conclusion on. The issues that may outrage the American public are;
 
The Abuse of the Abuse Petition:
  • These newly arrived immigrants are getting welfare or social service benefits that can amount to the 10's of thousands of dollars all paid for at the taxpayers' expense. To get these they need only to make the claim of abuse to the INS (USCIS). They then receive these benefits while their application forms (I-360) are being processed. This can take many months. [/*]
  • They get United States Citizenship at an accelerated rate. The fraud they commit, which is a Federal felony, is rewarded with the  precious citizenship of this country at a faster rate than those immigrants who adhere to the law. [/*]
  • The present laws with the INS'  internal ways that these rules are applied, encourages and rewards fraud. Not only to these petitioners but to criminal fraud rings operating both here in America and in foreign countries.  Green Cards and US citizenship are valuable. Those that can aid in getting these can demand a price. [/*]
  • The INS' system of accepting the "evidence" of abuse only from the petitioner as well as their lack of a system to receive "the other side of the story" from the accused plus there being no hearing with either party seems to indicate their wish to wink these cases through... Why? Possibly to avoid a time consuming and costly appeal process through the Executive Office of Immigration Review (EOIR), the immigration courts.  [/*]
  • American woman are now being targeted with marriage fraud and with it, it's false abuse charges. The INS is gender neutral about this and grants foreign men Legal Permanent Residency (LPR) status or a "Green Card" and eventual US citizenship because these men claim that their American wives abused and beat them. [/*]
  • Many INS personnel are sympathetic to American men and women caught in these situations but are powerless to help them. As of 1996 all spousal abuse petitions are handled by the Vermont Service Center. The local INS service centers that are in the position to hear both sides of the case and receive evidence from both the accuser and the accused are kept out of the process by the V.S.C. and directives from Arlington, Virginia. Under directives they are required to send the permanent files of the petitioner to the V.S.C. This effectively ends their involvement with the petitioner in regard to these abuse claims. [/*]
  • By INS directives the accused is NOT permitted to find out what claims the petitioner has made against him. Nor is he permitted to be a witness at her trial if she has one. The accused is given no opportunity to defend himself against her charges to the INS.   [/*]
  • The accused, a United States citizen is labeled "The Abuser" by the immigrant spouse in her or his INS petition and this is put into Federal files and INS computers permanently . [/color][/u][/*]
  • These in my opinion are the hot button issues that should be covered.

    I would recommend that you contact my immigration attorney Mr. Michael York. He expressed a desire to talk with on these above issues. His number is 1-888-529-9907 http://www.yorkimmigrationlaw.com Also you could ask about Mr. Dean Hove (pronounced Hove - vee). Mr. Hove is the retired District Director of the INS of Minnesota, North and South Dakota. He was an INS employee for 31 years. He is quite sympathetic (as are many other INS personnel) to these situations. He is a distinguished and eloquent gentleman that could give your program the perspective of an experienced authority of this issue.
     
    Here is two e-mails from a local service center INS adjudicator to me.

    Hmmm, okay.  One problem is that "extreme mental or physical cruelty" has no really set definition.  Another is that is it far easier to roll over and approve than to deny and run a case through the Immigration Judge, then on to District Court, Circuit Court, Supreme Court which costs a hell of a lot of money.  Third, your K3 was intelligent enough to sell a judge on one of those short-term restraining orders.  Fourth, it has always been difficult to prove "intent" at the time of marriage.  It may be VSC has yet to develop the spine to fight these, or to refer them to the local offices for adjudication.   Sorry I could not be more helpful.

    A client of mine, who just won a decision about an annulment of his marriage from his Russian wife after she tried to divorce him under the same domestic abuse claims scenario is being contacted by another attorney who is interested in putting together a group of victims to crack down on a ring of Russians working in Phoenix area to help RWs with the false domestic abuse claims.

    Here is the letter my client received:

    I just got off the phone with divorce atty. Cxxxx McMxxxx and somehow the discussion turned to annulment and she told me that she just represented a man in an annulment case who had a Russian bride. Without going into detail, the facts were almost the same as yours. She stated that there are two individuals named Olga and Art who are operating a fraud ring here in Phoenix to do this stuff.

    She said that there is an attorney here in Phoenix who is putting together a group of victims (like yourself) to pursue these individuals. The attorney is Chris Hxxxxxxx (602-34x-xxxx). I recommend that either you or Hxxxx call him.

    Let me know how this turns out.

    Also, I.C.E. (Immigration Customs and Enforcement)  was interested in my client's ex-wife's contacts in the USA and hopefully it is a good sign.

    I am most anxious to see what this Chris Hxxxxxxx is having in mind (and I hope my client does contact him!), and I am considering contacting this Chris H myself to offer him any help I can possibly provide.

    Do not you think that it is promising? At least SOMETHING is happening!!!

    I am thinking, that there may be some other attorneys around the country putting together their local "groups" of victims that I do not know about. I was thinking that the idea of a web site (just like the one you proposed the other day) could potentially be very useful in a sense that groups of victim's advocates could find each other, communicate with each other and hopefully achieve greater results together.

    Oh my God, may be there IS some light at the end of the tunnel?!?!

Also this program is being broadcast on FOX5 in the Washington DC area only. It is supposed to be broadcast this week maybe even tonight. So if anyone can tape this for me I would consider this a very big favor.

Many times if you contact the TV station, they will put a news story on videotape and send it to you for a modest fee.

The producer told Golden25 he would send him the transcript. This could come in handy for his defence although I think it is something the USCIS would have more interest in.

I rather doubt my information will find it's way into the program. Usually these programs deal with the more sensational aspects of these stories and not the Government's complicity in making this happen.

I have the means to digitize the tape and put it on an FTP server so we can all download and have it.  Is someone willing to send me the tape so we can do this?  A DVD would be even better because I can get it on my FTP server in a fraction of the time that way.

I can convert it to a DVD format. I also got two DVD players one with a DVD burner and a descrambler between but that won't be needed with a VHS tape. I am not sure FOX5 would allow a FTP server download. It least not appreciate us doing so. Of course they wouldn't care for me burning allot of discs and mailing them out either.

Cool thing is this will be broadcast in the area the head INS offices are (Arlington VA). If I could get the FOX station in St. Albans, Vermont to broadcast it the V.S.C. (where all the abuse petitions are processed) might see the problem that they contribute to.

The FOX station in Vermont (FOX44) is in Colchester, in the greater Burlington area.  They do NOT the news.  I could possibly hook you up with reporters from WCAX (CBS) or WPTZ (NBC), both which have a significant local news presence.

Thank you Connor for your offer. It would be great to get this story (If FOX5 DC does it right) out there. I'm working with Elena Garrett of Russian-Detective trying to organize this whole thing. My dream would be to get some undercover video of the scam in progress or in the planing stage and have this added to a report like this. Usually the false DV incidents with the arrests and trials are the dramatic point of a preplanned effort that usually originates in Russia, Ukraine etc and many times with the marriage agencies. Really an edgy program like 60 Minutes of some length is whats needed. There is so much that needs to be shown to understand the complete picture. But that's a dream and I have to be practical and work with what I have.

   I want to thank you for getting me in contact with Fox for the interview about my RW and pending DV case.  I gave the interview tuesday evening the 21 st of feb at the local FOX affiliate in Sioux City Iowa, KPTH FOX 44 - they sent the interview to Fox in DC. I think the interview went quite well, although it certainly was not enough time to tell the whole story. the gentleman conducting the interview was quite nice and we talked for about 20 to 30 minutes,  they posed questions to me as follows

What made you decide to search for a Russian wife?

How long did i correspond with Elena? did i go to meet her in Russia?

When did we get married?  

When and what did i see if anything going wrong with the marriage?

What is the status of my situation now?

Where is Elena now?

Do i feel Embarresed about the whole situation?

Do i feel Elena deserves a greencard?

 I was told Fox in DC was also interviewing another man from the east coast with a similar situation as mine. Fox also has a translated copy diary and some other letters she wrote as well,  Fox also asked me to take some photos of both Elena and I  together  and some photos of Elena herself and Her daughter.  I don't know how much of interview i gave fox will use, and i certianly hope they do not make me look like a fool, but i guess thats a risk i am willing to take.

Never suprises me when someone gets caught because they keep a record of the things they do.  I had a guy I worked with who used to keep a journal (he was clean for years in a drug program apparently one of the "steps" is to record your life to look for ways to better yourself) of all the women he was messing around with on the side.  Of course he was supprised when one day his lady found all this out because he left his journal out and wide open.  You would be surpised how often people undo themselves.

Golden's Elena was careless because she thought she has the gods watching over her as in "The Higher Powers protect me". My guess she figured these higher powers got her to America and will get her that $10,000,000 and a mansion over looking the ocean in a "Good State" etc. Golden to her was just a lackey that should help her with her goals then step calmly aside or suffer "Fear, Horror and Pain". I seen this same narcissim and unrealistic notions in my RW ex. In fact this is typical behaviour in marriage scammers. Live with a woman like this any length of time. Then have the finaly of false DV charges and watching the government aiding, abeting and rewarding this criminal behaviour and then see how well your nerves take it.

Don't you have in US law about private live who don't allow the use of photo from people without agrement ( Elena but more specialy about her daughter ) ?

Her photos with her written by her own hand diary broadcast on TV? She'd be a fool to try anything. He's also got her own cousin willing to testify of the scam with false allegations told to her by his wife. This cousin was deposed by his lawyer and this is in her deposition.

   Fox was aware before i did the interview that my DV case was still pending, i am sure any Legal issue from this would be on the civil leval [ not criminal ] and fall on Foxes shoulders not mine.  although she would be fool to draw anymore attention to herself.

I was a simple question... because here in Belgium, the photo with daughter ( when she is minor ) can really be a problem... specially when the face can be see clearly and real name ( or other information who can lead to identification ) are used in the reportage...

I don't see her make problem for this... but maybe other organisation... in my country, a organisation like "child focus" can make a process because a "innocent" child was show in a bad story...
