Hi from Va.
« on: December 25, 2011, 02:18:09 PM »
I have met a women in the Ukraine.  I visited there in July 2007.  We have email and Skype.  My question: is it faster to get a visa by marrying in her home country or wait the two years for a K1 visa. I did not meet her on my first visit but met her through a friend in the Ukraine. Thanks for the help,  Phil

Hi Phil and welcome to RWD!

There isn't a 2 year wait per se' on a K-1 visa. Some can and have taken that long but they are the exception and not the rule. The answer to your question however is no, it isn't faster to marry her in her country to have her with you in the US. Cradle to grave time for a K-1 is about 6-8 months if all goes smoothly and they do not require more evidence. The K-2 can and usually does take longer.

It's just Ukraine. Like we don't say the Texas or the Virginia.
:welcome:    It took 7 1/2 months from petition to visa for us.
Milage varies here and there.
Good luck

You are talking about a K-1, marrying her here, versus a CR-1 marrying her there. A K-2 is for a son/daughter under 21. Typically the K-1 is a few months longer and a bit more expensive. But marrying her there may require an additional trip so it sorta all washes at in the end. I also believe that if you do the CR-1 you may not have to adjust status and save some bucks there as well. It really depends on what you and she want to do. Most men want to bring her here first to get acquainted during the 90 day period to make sure things work out ok.

It's a little confusing as to whether you have actually met  her in person,
it's only clear you did not meet her on your first trip.

*Meeting* through friends on skype or email, is a good beginning,
yet to file a K1 you'll need to have met in person ,
and file proof of that with your K1 petition.
(there are excpetions, but you'd need to maker a case for them based on religious or other factors that would apply to your not being able to meet in person)

If you've met in person ,
it's about 6 to 8 months processing time.
(it can be as littler as 4 or 5months , or it can take longer)

A CR1 , marrying her in her country , is different , but around the same general process times for the visa.

my friend married to a lady from Ukraine. he hired a professional attorney and it took them only 5 months to get K1 visa. so it is definitely better to take your lady to US and marry there.
if you were from Canada then it would be easier to marry her here in Ukraine
