Visa to America and coming for a 2nd visit
« on: August 09, 2006, 08:33:15 AM »
Hi all -

My Mother-in-Law is here on a Visitor's Visa for 5 weeks (less than one left).  My wife is expected to give birth on 9 weeks.  My MIL would love to return for some time thereafter to help with the new baby.

I vaguely recall that her Visa is good for 6 months, but I don't recall if we (e.g. America) have the same concept of "single entry" and "multiple entry" as FSU countries do.

Bottom line:  I'm curious if she needs to apply for another Visa or can use her existing one?

Look at her visa and it will tell you.  I think the one year ones may be multi entry and the 6 month ones are single entry but I know about as much about that as jb thinks I know about anything

Goombah,
It's possible but unlikely that she'd be issued a 6 month single entry. Perhaps you're looking at the date on the I-94? Usually tourist visas are issued as a 1 year multi, but a two year can be had for the asking (and an extra $100 in fees) in most cases. As suggested, look at the visa and it will tell you quite plainly. As long as the field marked "entry" doesn't say single she can re-enter, but be sure she has R/T tix that leave BEFORE the expiration that she can show the POE officer, if the trip is planned near the end of the validity period.

I initially had the same thought as you, Jim.  Then I read this blurb on the US Embassy in Ukraine web site:
Quote
Please note that as of July 1, 2005, there are no visa issuance fees for Ukrainian citizens. Both single-entry visas (valid for six months) and multiple-entry visas (valid for five years) are free of charge. There are no visa issuance fees for any other nonimmigrant visa category for Ukrainian citizens, with the exception of blanket L (intra-company transfer) visas, for which a USD500 processing fee is assessed.
(source: http://kiev.usembassy.gov/visa_nonimmigrantvisas_eng.html )

So it seems different than what is issued in the US Embassy in Moscow.  Best way to be sure is to read what it says on her actual visa.

Just to wrap this up, I did indeed take a look at their Visas.  They are good for one year and are multi-entry.  Note these are for Russians, not Ukrainians.  Per their I-94's, each stay can be up to 6 months.

My MIL may be coming back after the baby is born... which would be nice.

Kevin,

Be aware that the I-94 specifies the maximum length they *may* be allowed to stay. Upon entry into the US, the Border Control agents will specify the length of approved stay - and it can be less than the 6-month maximum.

Your in-laws will need to tell the agents each time they enter, how much time they want/need to be in the US.

Just a heads-up.

Not exactly Dan, the I-94 is filled out by the border control agents, and it is *exactly* how long you can stay.
Everything else you wrote is completely correct  ;)
