My son is planning to head back to Ukraine for a follow up visit to the gal he met on Jack's tour and really has fallen for.  I am not sure when it will happen but I would not be surprised if at some point it leads to a K-1.   The biggest hurdle is likely to be the fact that she has a two year old son and there are some concerns about the father letting him leave the country.

The part I want to really ask about is that I think I read somewhere that where there is a child involved the natural father must go to the interview with the woman and sign the permission there and then for the child to leave the country.  I am hoping that I dreamed that and that all that is required is a notarized statement that he allows it.   It sounds like a really awkward situation if the ex has to go to the interview.   Can anyone tell me for sure?

In Ukraine, the ex used to need to be present at the interview, but that requirement was dropped in the recent past.

Here are the options for a child K2 visa and noncustodial consent-

1)   Court order terminating parental rights
2)   Death Certificate for non custodial parent
3)   Unamended birth certificate showing no father
4)   Notarized letter from the non custodial parent stating that he is giving   permission for the permanent departure-or what ever- of the child. The letter must include a copy of his government identification.
5)   The father appearing before the consular officer and giving consent after being sworn.
