I am confused. (so what else is new?)
« on: December 16, 2006, 10:56:35 PM »
The one year and nine months you must wait to begin the process to remove conditions, do you start counting with the date your AOS is approved or is it 1 year and nine months from your marriage date?

I seem to remember it as being 1 year and 9 months after the AOS is approved but a friend thinks it is the marriage date.

I need the answer so both of us will understand.

Thank you.

1 year 9 months from the day the AOS is approved. You cannot apply 1 year 8 month and 29 days, won't be accepted. And you have 90 days from the 1 year 9 month deadline. If you wait until 2 years and 1 day or later you have to explain why you did not apply during the 90 days specified time period.

No wonder you are confused.  That must be the most convoluted explanation I've heard.   :P

Easier to think:

1- Look at the expiration date of the green card.
2- Subtract 90 days.
3- Application to remove conditions must be received between 90 days before the expiration date, and the date the card expires.
4- Mail application via certified mail w/signed receipt (USPS) 89 days before the card's expiration date.

Jack, Jet, and Conner are exactly right.

You are removing conditions on a Green Card, not doing an original AOS on a two year old marriage.

Clyde,
Man, how ya doin? This may be redundant but I agree with all and even my new adopted brother. I asked the AOS agent when we went. It's 90 days before expiration of current GC.
