I think the rule is; if they rely upon you for more than 50% of their living expense, or if you can claim them on your income tax as a full time dependant, then you should list them as those who you are required to support.
Check with a good tax atty to get the absolute answer, (I'm not one), but I think I'm in the ball park on this one.

Suppose it won't hurt to list them - shows honesty.  I'll mark them as "partially support" and designated as "Ex-wife and daughters".

Kevin,

I'd be careful to make sure the payments to the ex-wife and children don't show a really adverse effect on your overall net income. Alimony and child support will make you look poorer on your Afidavit of Support.  Hopefully your net income after taxes and court mandated expenses are well above the poverty guidlines, otherwise you are screwed.

The form doesn't actually ask for how much my payments are, only who my dependants are.  Of course, they have a complete copy of my divorce decree so have that information available.

Fortunetly I'm still well above the poverty level - depending on bonus, stock option sales, and the like, potentially still over $100K.  Of course, you can't count on those things, but they are reflected in the last couple of years of IRS filings that they also have copies of.

I wasn't even sure they were going to ask for it, but I just filled one out and had it notarized.

Also wrote a fresh "Letter of Intent" to include.

So... when I meet her in Jamaica on Thursday, I will take her:

1) Fresh letter of intent
2) Notarized I-134, with a web-shot of my bank account and IRS reprints of my last 4 years tax returns (the shorter form, not photocopies)
3) A certified copy of my divorce decree
4) A photocopy of all the original I-129F (K-1) paperwork

Am I missing anything?

ps.  Today was her last day at work.  She has been there for 8 years now - this couldn't be easy.  Her house is up for sale as well - she will live with her Mom and Dad if it sells before she comes here (which it should).  I think it fair to say she is really committed to this process!

Well than I should be golden.  I pay more in taxes than the average American makes (or darn close to it!).  I would be sitting nice if my Ex would just marry someone new - but she isn't over the divorce yet, and the judge was very, very, generous to her.  Things are tight, not impossibly so, but not like they were when I was married.  Of course, I'm happy now - and was on depression medication then.

Sent my RFE response by US Priority mail on Saturday, just received an electronic notification that they have received it today (Monday).  Oddly, two from USCIS-CSSO and one from CRIS 1 minute later (whomever they are).

"On August 1, 2005, we received your response to our request for evidence or
information. It is taking between 80 and 110 days for us to process this kind of
case. However because preliminary processing was complete, the remaining processing
time will be less than the maximum stated in this message. You will receive a
written decision on this case."

Don't know if that means until the Visa is complete or until Nebraska is done and sends it onto the National Visa Center who then forwards to Moscow...

Shall we start a pool on when her Interview date will be?  Maybe I'll start a poll instead (that close to "pool", right?)

Excuse me?  Where the h*ll did that come from?  I have two daughters that I have no intention of abandoning, and I'm legally divorced from my ex-wife.  High on Evia's list is making friends with my kids, as is her daughter list.

I think this is my  first post here but as for your poll, I'd guess that her interview will be mid December according to the current Moscow processing rate. Mine is 10/18 and we got our NOA2 on 6/14. The good news, i bet you get your approval this week!

Hi and thanks guys,

I've been posting over on VJ since the beginning but I was so busy I never got around to writing over here.

My girl is from Yoshkar-Ola in Russia near Kazan and we met online like most. This is actually my second K1. I was married to an Israeli woman for close to 10 years that I met while working over there. Towards the end of my marriage I started looking around on the local dating sites to see who was out there but to do so you had to put your own profile up. Well I started getting letters from Russian women and I remembered all the incredibly beautiful RW I met in Israel so I started investigating.

Long story short I met Marina on 12/23/04. We spent 2 wonderful weeks together in Russia and I submitted the K1 on May 2, that was 93 days ago. Now we have just 77 more until her interview.

Well that is my story and I'm sticking to it!

10/18/05 - Interview!!!
12/17/05 - Our Wedding Day!

Do you really want to know? Actually we planned to start trying for a baby one year from her arrival, give or take a day or two ya know. But Saturday she happened to be at a cousins home near Ufa for a mini vacation. Well her cousins (3 women) all have little ones and I guess this kicked the baby making instincts into overdrive. Now she says she's not so sure she wants to wait the year! Fine with me as I'm ready when she is. After all I'm 38 and she is 26 (she will be 27 soon so it is 11 yrs not 12). Better get started before we reach ages where things may get a little more difficult. Besides I love this woman more than air!

Oh and before ya'll start knocking me for planning a wedding and all that before the visa is in hand don't worry, all I did was put the deposit on the chapel. Also we are telling everyone the date but warning very strongly that it is not solid until she arrives. I have read all the horror stories of folks planning every detail then not getting the visa in time. That would be a tragedy. As for us are plans are tentative based on the visa. They can be easily changed.

Also thanks for the complement on Marina's beauty, I have to agree. I think she is amazing!
