Extending Visa
« on: April 26, 2007, 08:59:40 AM »
How hard is it for MIL from Russia to extend her visa?  Should she do it before she arrives here or when here?  Any pointers on how to extend her visa?  She has a one year multientry.

My MIL's visa expires the end of October.  We would like her to stay longer, primarily to help with our daughter so my wife can devote more time to her studies.

She has to enter before you can talk about extending her stay. Her initial term of entry will be determined on arrival. Do NOT mention extending on arrival in the US.

She should be planning on honoring whatever commitment that was made in the application on the current visa.

Extensions can be requested for any good reason. However, there may be an effect on her ability to gain future visas to the US if there is an extension given.

Keep in mind that it is not the validity date on the visa that controls- that date determines her ability to enter. It will be the date of expiration on the I94 arrival departure document that determines the date when she must leave.

Does the US Visitors visa preclude any form of work, even unpaid? I think our UK one does......

A B2 tourist visa does not carry work authorization of any kind.

She can definetly extand her visa, but only when she gets to the States. As it was mentioned before, she should not mention anything about extending her visa at customs upon arrival.
When she gets here, you can apply to Homeland Security for an extention. Just do not forget to include check to US government  ;)

So won't the OP's MIL be working and therefore in breach of her visa?

No work for wages so no violation. A violation of status terminates the visa as of the date of violation.

William, thanks for the information.  Will try to implement after she arrives.  What is with the Avatar?  I thought you were looking for RW now.  How could you ever think of changing your Avatar from the photo of Bruce Willis  :cluebat:?

Thanks for asking, Bruce- Thailand will always be my first love and my second home. . . . I will retire there in a few more years

Besides, that is really me in the picture.

You are welcome!!! Good luck with the MIL. PM me after she gets in and I can give you a few pointers in detail-some that i already posted here, so you understand the rationale.
