Another K-2 question

We've tried a few ways to get the dad to sign an affidavit so that the child can travel with mom, including money but he is refusing at this point. It's not that he cares for the child as he doesn't make attempts to visit or spend time with him, it's that he wants to control the ex-wife. They've been divorced for over 4 years now.  The time involved for an attorney to go to a judge could be 6 months. Once again, is there anyway to speed this process up? The city in Ukraine is small, maybe 30,000. Has anyone known or have had friends that speeded up the process for the mom to get sole custody and an order signed by a judge with the offer of a benefit we will call it. Does anyone know the complete process? What I have gleaned so far is that the mom must get an official from the childs school stating dad isn't around, no problem there, she must go to one of the dad's old jobs and state he was virtually worthless there, then this must all be processed and of course this is where the lenght of time comes in. Does anyone know a short-cut? After-all this is just a document that states she had custody.  Any suggestions will be appreciated. I know it's easy to give a benefit to the police, but how easy are small town judges. I'm sure a local lawyer that's friend with the judge might help, but how strict do they have to be with these decisions?

That is a tough one. Without a court order granting sole custody, it will be hard. You might have to hire a lawyer there and to speed it up, you may have to have him/her bribe someone in the courts. The big problem is that US embassy will not approve without a signed waiver, court order or certificate of death. Since he won't sign, the only way is through a court order. If he has not been paying any child support on a regular basis, it will be fairly easy to get court order but still would take time. You could ask for extension on K1 if it has already reached embassy. Request 6 month extension for interview. They generally have no problem with that, but if you do, remember you will have to get police certificate again, send updated tax returns and bank statements, which should not be too difficult. Other than that i do not know of any other way around. In general I would think there is something the ex wants, even though he says otherwise. Hopefully it isn't something ridiculous like a new car, but these men over there no the laws. I wish you success.

We're in the process again to try some sort of negotiation. If it's successful what all does this document for his permission need to say. I was thinking something like this.....

  I ---his name-- give permission for my son ---his name--- to travel and live in the United States with ----her name---- for the purpose of immigration. I also understand that I wil not be required to pay any child support.

The consent looks good. You don't have to worry about child support, but if it makes him happy, put that in the statement. Have it written in Russian, with exact spelling of name as listed on birth certificate. You are right, it must be signed, dated and notarized. Also make sure you get a photocopy of his local passport including signature page.
