I-751 Story - Please comment!
« on: November 23, 2007, 09:43:14 AM »
I would like to get some advice from those in thee forum. We recently celebrated our two (2) year anniversary  :-* and applied for the I-751 for my wife to remove conditions. We sent in the obligatory stack of papers that shows we have a real relationship and our check for $ 545.00 for the "new, improved" service.

The only wrinkle is that we recently moved from Pennsylvania to New York State and sent in our change of address the day that we closed on our new house. We received confirmation of this change of address.  This was 1 October. We submitted the I-751 - 90 days prior to the expiration of my wife's first green card an received the standard case number back.  The notice date was 29 October.

The problem begins when we try to status her case on-line or via telephone. There is no record of her case number yet. We managed to talk our way through the first phone screen for the Dept of Homeland Security to a real agent, but the real agent was quite nasty to my wife, refused to look up her case because it was not 45 days past the notice date. This was after a 40 minute wait on the telephone line of course. My wife has also not received her appointment for fingerprints yet. The agent told my wife not to call back until 45 days have passed for the notice date.

Before we moved from PA everything worked smoothly for us through the Dept of Homeland security, now I am worried that her notice has not yet appeared on line and that she has not received her fingerprint appointment yet. On the Russian Fiancee forum, others in our situation have already received the fingerprint appointment and can track progress of their case on line.  We are thinking that our change of address may have slowed the process down somehow.  We still work through the Vermont Service Center.

Any recent experiences or advice would be appreciated. Maybe there is nothing to worry about but I am still anxious about this situation. Thanks!

Did you turn in an AR-11? What address were you using on the application?

That aside, your 751 interview if scheduled, will be in NY and all papers will come from NY.

Call back or make an INFOPASS appt when the 45 days have expired.

That would be my advice as well. We got the biometrics appointment a few weeks after we got the receipt notice but nothing since then which was about 2 months ago. I figure we'll give them 6 months then start InfoPassing them to see what the issue is/are.

After the major BS they put us through to get Sergei his GC I don't have a bit of faith in them doing anything right.

Good Luck!

We turned in the AR-11 with our new address.  On the 1-751 we also used the new NY address. I saw on the canceled check with the same receipt number - as on the mailed notice - written in handwriting. Maybe I am being too cautious but I do not like that such a long time has passed without being officially in the system.  I guess we'll wait for the 45 days, but I also do not have faith that things will work out if I am not pro-active about it. :-[

Give it the 45 days then be proactive. Big problem with these scuzzy assholes lovely government workers is that you can not be proactive ahead of their schedule.

Good Luck Dude! Keep us informed.

The problem with being proactive in an immigration case before its time has come is that you can get your case lost through harmful or offensive touching as it gets misfiled inside another file jacket after it is "looked at" and then put back.  :'(

To update this thread, yesterday we received the fingerprint appointment, thank God. So it seems we are slowly making our way through the system.
