Question about mother-in-law petition for greencard.
« on: November 21, 2008, 06:51:03 AM »
My mother-in-law certainly has her faults, but she has her ways to. Of course she thinks I'm the anti-Christ most of the time because I married her youngest daughter and moved her  somewhere around 5500 miles due southwest of Kharkov. Currently she has a 5 year multi entry vise an she's been here a number of times. Of course I dont have to get into the economic situation in her village to understand why she likes it here better. We also have a 2 year old daughter that she thinks is pretty sweet as well. The last time she came was in May and she stayed 3 months. The immigration guy asked her why she came so much and told her after she leaves this time that she cannot come back before January. Keep in mind that 3 months is as long as she has ever stayed at once. She always gets a 6 month window.

What is the process for applying for her a green card or residence card? Can someone be so kind as to talk me though the steps. I know I could pay a lawyer in Atlanta upwards of $1200 to fill out the paperwork, but I actually filled out and filed a DCF myself when my wife and I were married.

Has anyone here done this? The thing is her visa will expire within about 2 years. I really dont want to reapply for here because she has obviously made a number of trips here. Getting the visa wasnt easy and we were turned down once.

YOUR WIFE can apply for her as an immediate relative the day that she is sworn in as a US citizen.

Apply for what? What paper? I should be able to download the forms right?

We would be satisfied just getting a tourist visa for my wife's Mom. She interviewed in Kyiv twice last summer, the last time with a letter of support from one of our State Senators and still was denied. They never looked at her supporting documents including banking, home ownership, and immediate family information. It was a bad experience.

If there is a secret out there, we have no idea how to get her an approval.
Currently in process of Fiancee Visa.
Petition Approved 8/7/2007
Stuck at NVC since August 22nd.

First you need to submit an I-130 which will get her a visa to the USA.  Then you fill out a change of satus form I-485 which will get her her green card.
Just stating my opinion!  You don't have to agree with it.

This last summer we got lucky with getting a tourist visa for my wife's Mom. Something that may have helped , is she has traveled to other counties, but most likely it's just the luck of the draw. :wallbash:

Good luck with this. Is your M-I-L married??Maybe you should call the embassy. My M-I-L was turned down the first time and it really pissed me off. I laid in wait by the embassy until one of the Americans came out and I got to know him pretty well. I actually told him he would get tired of seeing me everyday but that I wasnt going to keep spending $120 just to keep gettiung turned down. I had my senator address a letter to him personally and I also wrote one back explaining that there is no way in hell I would want my inlaw here full time. I dont know what the deciding factor was but it worked....I would just keep calling and set up another appointment...There is also a name for some fee that you can offer to pay to insure their return but I dont know what it is...I think the fact that my M-I-L was married and had another daughter in Ukraine was a big help. Just keep writing and calling. Turn it into a game that you just have to win. They'll eventually cave in hopefully..

Greg-

You do know of course it is your wife's petition. As soon as she pledges the allegiance, she literally can file the proper paperwork for your M-I-L.

You, as always, simply becomes an added sponsor.

Currently, we have a AM/RW friend here in LA where the mother was already here on a tourist visa when she (mother's daughter, wife of AM) became a citizen and they had sinced filed the paperwork to keep her here for/with a legal residency card.

Good luck with this...the paperwork, not with the M-I-L  :D

Just fill out the form,,dont leave anything blank and send it with the amount stated. You can pay a lawyer if you want to. My wife as sent hers in for her mother. Think it will take 6 months or so. Her mother  is a widow and I have pushed my wife to get her mother here. If my wife and me have to go to Ukraine if her mom got hurt  would cost way more in money and time off of work. I dont have any problems with her mom living with us.
