I think she would be status pending instead of out of status. Have you tried to do some searches on the USCIS web site? Yes, there is a LOT of BS to wade through but they are the holder of the cards so to speak. Anything said here is to be taken with a grain of salt.

Correct! She is a non-immigrant pending adjustment to LPR (legal permanent resident). She is in immigration "limbo" until LPR status is officially granted. If she travels on Advance Parole she will go through the same lengthy processing she did when she entered on her visa originally (depending on airport and # of flights comming in that day it can take from 1 to 6 hours longer than it takes you to re-enter the USA)

Also, once you file for AoS your wife CAN NOT legally work until you file for and RECIEVE her new 1 year EAD. Upon their reciept of documentation proving she is married, she is no longer a K-1 visa holder.

And once she finds out that her previous experience and education are meaningless here and she discovers that she will be a secretary or cashier until she gets re-educated and some job training here will make her even happier!

Elena will be starting college in January when the next semester starts and is working now in a basic store clerk position until she can get back into what she has training for. Will probably take 2 years of college and some specialized classes after that.
