I-131
« on: November 01, 2005, 05:57:38 PM »
I'm spending much time getting my docs filled out and ready to send. For the I-131, is it really necessary to send this doc in at the same time as the rest of the packet(485-765- G-325 etc) or can it be sent later?  And about how long does it take to receive it back. Do I also have to file one for our minor child? In part 7 it asks to write on a seperate sheet of paper how she qualifies for advanced parole and what circumstances warrant the issuance of the doc. What did you guys write?

Also just double check, the new affadavit of support is the doc 213A? not the I-134. Correct?

This link talks about INA section 213A but the only form I see on the site for Affidavid of Support is the I-131.

http://uscis.gov/graphics/howdoi/affsupp.htm

We filed all the AOS and Advance Parole documents together and got the AP document back in about 2 1/2 or 3 months. You don't have to file the AP with the AOS. The child is the K2 dependent of the K1 visa holder.

Page 3 section B-1 of the instructions states her ability to file for this document. She is K-1 with pending AOS.

Best of luck!

I think the form (Affidavit of Support) you need to file with the AOS is "I-864".  The I-134 is used if you sponsor an immigrant other than a spouse.

 http://uscis.gov/graphics/formsfee/forms/i-864.htm

If you look at this page you will see it is specifically listed as a requirement for the form I-485, Application to Register Permanent Residence or Adjust Status.  This one is the 10 year Affidavit.

Yup, that's the one. Part of the I-864 package. Never mind..... (how quickly we block out all memory of dealing with USCIS ;))

Once again, you guys came through. I think sometimes I tend to be a little to cautious when filling out these docs. Hence, I overlook what's right in front of me. I see now on the form in small numbers at the bottom that the I-864 is actually that 213A doc. It's just that when I went to the USCIS site and Visa journey, when I'd click on I-864, that  the doc that says something like 213A  act would pop-up. I'm not one that likes to have to do paperwork twice so the simple will sometimes appear difficult. Anyway, thanks for steering me in the right direction.

I noticed I caught an increase in doc fees as well. :(   At least I did catch a break since our son who is under 14 and a bit cheaper on the I485. One things for sure, this packet is as thick as the I-129 I had to send in. Geez Louise!!Hope to have all this in the mail by friday.
