I made the phone call to the us gov telling about her plans. They asked alot of info and spoke they would forward it to the right people. How can i know if something really will happen? Do they really care?

That will largely depend on who you spoke with. However if they asked a lot of questions, thats probably a good indication that they did care.

What country or embassy did you call for the USA government?  You still never answered my question about are you sure she is Russia and not Ukraine.  I know women who have passports for different countries. 

I have three working passports currently for the USA myself.   :D

Hi.

Yes i am sure she is russian and not ukrainian. I did background check on her before we met. And i know her mother and father. Definitly Russian. I called for the us goverment. They seemed very interested. And asked alot of back up questions. And she was very interested in all possible details... She said she would pass this info on to the american embassy. And so i specified that it must be the american embassy in russia and not norway.

And she speak all time about aids test, she was recently in hospital in russia, and so she is afraid it was not clean. But i know she need aids test for the visa and i suspect that is what she really thinks about..

Why I have 3 passports.

Passport 1 - I had. Normal like everybody.

Passport 2 - Stopped a mugging of a husband and wife getting a beatdown by 3 men in Brussels.  Police took my pasport (this was Thursday night) and said I need to come to the office on Monday to write a statement on what  I saw.  I told them I am going to Ukraine and Friday and need passport.  They told me not their problem.  I told USA embassy in Brussels on Friday morning I lost my passport and got new one in 1 hour. Off to Ukraine and second date with woman now my wife.

Passport 3 - Confidential from government.  Due to me traveling toughout middle east and other Muslim countries.  Not a blue cover and discreet on USA country.  So I do not get a beatdown for being an American. :D

I tried to turn passport 1 in but immigration gets confused.  So it is easier for me just to have 3.

To receive her K-1 visa, she must be interviewed by a consular officer at the US embassy/consulate nearest her residence (the resident address she entered on the visa forms).  Prior to the interview, the Embassy will send her a packet of new documents that she must have completed when she arrives for her interview.  The most notable two are a medical examination and a police report for every place she has lived.

Do you have the address and name of the man who petitioned (filed) for K-1 visa?  Also, how long ago do you think her application was submitted to the US Government (it may already have been processed and approved - takes about 6-8 months from the initial submission).

I know that she is registrated residense in spb. So she would be for this intervju in spb?.. When she was in america before (also k1) She was in moscow for intervju. But that is back in 2005.

I think they took the layer to help them explain why she was in norway. And i think that they will probebly say she was here for work only. The sticker in her passport (permit to stay in Norway) Translates to workvisa. This is becauce when she come here on the familyvisa, we always make it a work visa becauce then she can both work and stay. If do only a familyvisa, she cant work until she was here 3 years.

Anyway my wife is very well educated and she never trusted the norwegian helthsystem (hospitals etc). So when she was ill and for some operations she went in russia. So this aids talk is very unusual. If she was here for operations and did not know all systems and cleanlines i would understand.

I heard them speak that this visa would maybe be ready for the summer..maybe august. Does that mean it has been aproved already? Maybe i should call tha consulate in spb to let them know if she will be there for intervju they should check with norwegian goverment if she is married. Or maybe i just call and say that i call consulate and say that we forgot which time we are schedueld for intervju and so i will know if this is for real or not??

If it has already been aproved, is it to late to stop it? even if it is polygamy?

I know this mans name, telephone nr, city. I also know his aprox age.

You said you already contacted the Embassy. You did your part to keep things straight, now just concentrate on yourself. Move on and start your recovery and focusing on the next phase of life.

If a little revenge would ease your pain and help you move on, I suggest that you email the following letter to the US Embassy in Moscow (the email address is consulMo@state.gov):

Subject:  Visa Fraud

Dear Consulate,

Although my Russian wife and I are still married, a reliable source has informed me that she plans to enter the US illegally via an Alien Fiancée Visa.

The petition for Alien Fiancée Visa was filed by:  (the name and address of man).

My wife’s name is:                 .  We were married in Norway on  ____(date).  Divorce is probable; however, neither of us have started divorce proceedings.

I reported the above to the US Embassy in Oslo.  I am following up to make sure this is stopped.

If you need more information, such as a copy of our marriage certificate, you can call me at ____________.

All K-1 Visa's only go through Moscow now.  Maybe in the past it was different.  All medicals are in Moscow, except for Vladivostok.

He may have.  He would not have needed to do this.  The beneficiaries signature is not absolutely required, at this time, on the original G-325a.  According to a USCIS memo I read from a link in a post at VJ.  In cases such as this a note is made and a signature is obtained at the interview.  Although advice was given to not take the chance of an RFE.

USCIS has a policy not to hold up or reject an otherwise properly filed petition, for the lack of a signature on a G325a. The problem is, any given adjudicator may not be aware of the policy.

Just to give you a little more info, Bobb is correct. All interviews and medicals go through Moscow now. All you need to do is to inform the US Embassy that she is married, file for and obtain a divorce and move on. If she is filing for a K1, she will have to go through a whole process to get it and one of the things she will have to do is prove that she is legally (in America) out of any marriages she has entered into. If you don't send her a copy of the divorce papers, she will have to contact you to find out if and where you got the divorce and get a copy of the paperwork as well as a translation to take to her interview for her K1.

And don't give up. My wife is from St. P. and we are very happy. I started writing to her in 2000, we met the first time in 2001. She came here in 2003 and we were married before her visa ran out. Since then we have been very happy. Her daughter graduates from college this year and has bought her own house. My only other advice would be, if you do decide to do this again, do a fiance visa first and spend some time together before you get married. Just to make sure.

Interesting to know: How long after first papers are sent for the K1 visa, will the interview be?

In Norway it's a little easier; if she finds out that he has gotten a divorce granted all she has to do is contact the central personal registrar and she will obtain proof of divorce within a few days.

Sorry for your situation. She will have her interview through the Moscow embassy as stated earlier. I would recommend sending a copy and English translation to the Moscow embassy and put the burden of proof that she is divorced on her. I don't thin anything sent to USCIS will amount to anything since they will only look at the submitted paperwork. The final decision will be made at the embassy. They will be the ones looking for fraud. When I filed my K-1 in January of last year, it took 9 months to get an interview date for my fiancee.

A question that was asked earlier (by Vaughn) has gone unanswered regarding registering a foreign marriage. Russian lives are documented in their passports. When a person is married, it is documented in their internal passport (not sure about their international) as well as any children they have. If it is not documented, then it doesn't exist. I have heard that some women have not been able to get their foreign marriages recognized and thus entered into their passports, but my fiancee's friend who lives in the UK did have it recognized and got a new passport with her new name. So I'm still not sure what the full story is. It may depend upon which republic/oblast they live in. In this case, no marriage exists (as far as the woman is concerned) because it isn't in her passport.
