Preparing wife for K-3 paperwork -- your advice appreciated

Hello All,

I continue to get better information here than I do from the immigration attorneys I hired, so here goes again ......... with another few questions for you all. 

I am working on a K-3 for my Ukrainian wife (waiting patiently in Ukraine), and am attempting to prepare her for the time when she receives the new so-called "information packet" from the US embassy in Kiev (as I understand it, the "information packet" replaces the old Packets 3 and 4).  I have discovered on the Kiev embassy web site the documents she will receive in the "information packet."  So, I now have both the English version and the Ukrainian version.  I am now sending the Ukrainian version of the InfoPak to my wife to give her time to prepare, with all the additional assistance I can provide along the way.  Here are my questions:

1.  Is there any Russian translation available of these InfoPak documents?  My wife is more competent in the Russian language than in Ukrainian, and she has asked me for this.  I looked on the Moscow embassy web site for Russian language versions, but that web site said that none are available except a Russian language guide for filling out other forms.  I can get her local help (in her city), of course, to help her understand the Ukrainian version, but she'd rather have the Russian version as a guide, if available through me or another source.

2.  The Form DS-230 (Application for Immigrant Visa and Alien Registration) is provided only in English, and must be completed in English also.  My wife's english is only about a 3 on a 1 to 5 scale (and much better in spoken than written English), and I want to give her help on this form.  I would plan to send to her on an identical form my recommended answers for her completion of this form.  Have others found this to be the best solution? 

3.  On the form (DS-230), Question 34 asks if the applicant (my wife) received assistance in completing the form.  But, if she answers "Yes", and says that I helped her, would that "Yes" and identifying me as the helper in any way work against us for visa approval?  I think I need to help her in order to ensure that her answers are consistent with the information I present in my forms (I-130 and I-129, etc.).   

4.  The medical exam for the K-3 visa in Ukraine used to be something that could be obtained at the American Medical Center, but now seems to be limited to the "Clinic for Oil Refining."  Further, it now appears that the medical exam cannot be scheduled until the visa petition that I sumbit has reached the Embassy in Kiev, at which time the visa case is assigned a "KEV" number.  Does this seem correct?   Should one request the interview date only after completing the medical exam? 

5.  From the medical exam information, it now looks as though it is optional to get the immunizations in Kiev (before the interview) for "K visa applicants."  Has this been the experience of others' wives also?

6.  How many days or weeks out is the Clinic scheduling medical exams?

7.  How many days or weeks out is the Embassy usually scheduling interviews?

4. 2 weeks (in my case at the Russian embassy). I don't think at Ukranian it would differ... She will find out much more from statistics in the site I mentioned above
5. She better get vaccinated in Kiev before the medical examination
6. Usually the package has the addresses of clinics, so she can call and make an appointment >2 weeks before interview date,  examination takes 1-2 days
7. In my case they put interview date on their site 2 months before. In Kiev it might take not that long.

Thank you for your kind help.

Unfortunatly, my wife does not have Internet access.  I do, and I am trying to read the information at the links you have provided.  But, again, unfortunately, my ability to read the Russian language is minimal.  I will print out anything that seems helpful, and send it to my wife for her to read.  I can say that she is amazed by how helpful many Russian and Ukrainian ladies can be for each other in these forums, and is looking forward to being able to communicate with these ladies in the future.

Be aware that the official stance on the Kiev website now states that they will no longer mail out the packets and say that you have to download them yourself, and that it's up to you to contact them when you are ready--so don't sit around forever waiting for it to come! I say "official stance" because even though their website has said that for months, my own fiancee  received hers anyway--yet others have reported they didn't receive theirs.

1. I am not certain, but it's my understanding that all official Ukranian documents are in the Ukranian language. Maybe it's different since it's actually the U.S. Embassy sending them out. I don't recall anything definitive about it on their website, sorry.

2. (N/A for me, my fiancee hasn't ever asked me for any help w/English. Ever considered getting her a personal tutor until she leaves?)

3. IANAL, but I would only write your name down as the helper if you actually filled it out. If she fills it out, then I wouldn't.

4. Once the NVC has sent your case on to the U.S. Embassy in Kiev and they have received it, you have a case number (prefixed with KEV) and can schedule an interview!! So if you have received the "NOA2" (secnd notice - approval) from USCIS - do it ASAP.  Last I checked, scheduling an interview in Kiev is 8-weeks out so you have plenty of time.  Be aware that the 'free' local 044 number for the embassy in Ukraine is practically impossible to reach--so you will probably have to call the 1-888 number from the U.S. and do it yourself. Have your KEV#, her full name, international passport number handy. Also, you have to buy a PIN number for $12 to get 8-minutes of talk time (what happened to using our tax dollars(!)).

...Do you have your KEV # yet? Realize that if you don't have it, you may have one but not know it yet. Go to the USCIS website and register an account and enter your WAC receipt number to see the current status of your case. If your case is still in 'pending' even though you've received an official approval letter, do not worry, they just screwed up (this has happened to myself and others on visajourney.com).

If you already have a WAC receipt number from your USCIS approval letter, but don't have your KEV number, call the NVC and ask. Failing that, write to the NVC via email (NVCInquiry@state.gov) and state your name, WAC receipt number, and fiancee name  and ask what it is.  (Unfortunately they are slow as hell and may take 3 weeks to respond, but at least you can get an answer.)

Тут та же система, если муж может за вас заполнить - то нет проблем, просто отправьте ему нужные ответы по мылу, он когда получит за вас её заполнит. Подписывается ВАМИ до интервью.

Вторая часть DS-230 подписывается после клятвы в посольстве


Посольства в СНГ, кроме Москвы, не имеют на своих сайтах списка интервью, то есть надо узнавать все по мылу и по телефону. Но зато отличаются просто дивной гибкостью по отношению к переносам интервью, если опаздываете со справками, можно перенести попозже, если уже все готово, можно перенести пораньше (были случаи). Все эти переносы можно вполне свободно осуществлять по обычному (не платному) прямому телефону посольства или по мылу. Отвечают чуть ли не в тот же час.

Как писать в посольство: Если ваше интервью в СНГ, то в посольство надо писать по-русски , там в сортировке писем наши сидят (и ржут небось над тем что им каждый день читать приходится). Не забудьте в каждом письме указывать номер МОС в теме письма - "CR-1 visa, case # MOS2005XXXXXX " так быстрее отвечают. Я писала так:

1. Анкета DS-230, заполненная НА АНГЛИЙСКОМ ЯЗЫКЕ (часть 1 и часть 2). Если с Вами выезжает ребенок СТАРШЕ 16 ЛЕТ, на него также нужно заполнить анкету DS-230.
2. Заполненная анкета Электронного Заявления на Неиммиграционную Визу DS-156. Электронное заявление должно быть заполнено непосредственно на сайте http://evisaforms.state.gov/ После заполнения заявления его необходимо распечатать. Электронное заявление на неиммиграционную визу существует только на английском языке, поэтому ответы на вопросы заявления должны быть на английском языке. Воспользуйтесь Инструкцией по заполнению Электронного заявления и переводом вопросов заявления на русский язык для облегчения процесса заполнения анкеты. Если с Вами выезжает ребенок, для него нужно заполнить отдельное Электронное заявление DS-156.
3. Приложение DS-156K («Заявление о предоставлении визы…»). Анкету DS-156К необходимо заполнить НА РУССКОМ ЯЗЫКЕ в одном экземпляре. Приложение DS-156К НЕ ПОДПИСЫВАТЬ! Заполнять DS-156K для иммигрирующего ребёнка не нужно.

4. Заграничный паспорт: оригинал + ксерокопия страницы с фотографией. Если выезжающий с Вами ребенок вписан в Ваш паспорт, необходима ксерокопия страницы с данными о ребенке.
5. Свидетельство о рождении: оригинал, ксерокопия, перевод на англ. язык
6. Для тех, кто ранее состоял в браке - документы, подтверждающие окончание предыдущих браков (свидетельства о разводе или о смерти): оригиналы, ксерокопии, переводы на англ. язык.
7. Справка oб отсутствии судимости и записей криминального характера: оригинал и перевод на англ. язык. В справке из милиции должны быть указаны все имена, фамилии и даты рождения, которыми Вы когда-либо пользовались. Справка должна содержать информацию о каждом месте (области, крае, республике Российской Федерации), где заявитель проживал или живет более 6 меcяцев, начиная с 16-летнего возраста, включая периоды учебы. За период службы в армии заявитель может предоставить справку об отсутствии судимости из военного комиссариата по месту жительства. Если Вы проживали за рубежом, справки требуются из тех стран, где Вы находились более одного года.
8. Совместные фотографии, а также телефонные счета, письма, подтверждающие отношения с петиционером.
9. Результаты медицинского осмотра в запечатанном конверте. Медосмотр можно пройти в одном из медицинских центров, аккредитованных при Посольстве. Срок обработки результатов медосмотра – около 2 дней. За более подробной информацией о медосмотре обращайтесь непосредственно в медцентры (список медцентров указан в желтом конверте).
Прививки
Мне хотелось, чтобы были включены не только необходимые для медосмотра прививки, но и чтобы ничего не доделывать по прибытии "на место".

3. Будьте осторожны с гепатитом Б те, кому (или детям) 18 лет. Дается противоречивая информация, с 18 лет она уже не нужна, или только с 19! Лучше перес&#

10. 1 ЦВЕТНАЯ МАТОВАЯ фотография анфас (просьба фотографироваться без очков и головных уборов) размером 50x50 мм для визы. Изображение глаз должно находиться на уровне 28-35 мм от нижней границы фотографии. 2 фотографии потребуются дополнительно для медицинского осмотра.
11. Деньги для оплаты консульского сбора ($100)
12. От Вашего жениха (невесты) – ГРАЖДАНИНА США потребуются финансовые документы для подтверждения того, что выезжающий не будет обращаться за государственными пособиями в США. Примерный перечень документов:
- налоговые декларации (1040) или распечатка из налоговой службы за последний год; во время интервью консул может также попросить форму I-134 (Affidavit of Support)
- выписка из банковского счета;
- документ о зарплате;
- форма W-2;
- письмо с работы.
13. Свидетельство о браке: оригинал, ксерокопия, перевод на англ. язык. Супружеские пары представляют ксерокопию и перевод свидетельства для каждого супруга.

You don't really say where your file is now but you can also call NVC once the file has arrived there, give them your Receipt number, or A#, the name of your fiancee and her birthdate and they will tell you the KEV number.   It is assigned almost immediately on receipt and the call is free.   You need to press one for English and 5 for a live operator.   They can tell you even if it has left there and been sent to Kiev.

     Much of what I am reading on this thread is EXTREMELY different than what I experienced.  Part of this is due to trying to compare the experience with the Moscow embassy to that of Kiev, part of that is because many of the procedures and timelines have recently changed and part of that is the difference between filing a k-3 along with a k-1 versus going the CR-1 route by only filing the k-3.
     If you're looking for the most recent experience with the process and the embassy in Kiev I'm probably the one as my wife completed her interview August 16th and arrived here 3 days ago.  Mine was strictly a K-3 application because in our situation there was no advantage and many disadvantages to filing a K-1 to try to get her here sooner.
     It would help to know just where you are in the process so we can direct our responses to the next steps - what to do and what to expect.
     I'll try to address your specific questions as best I can:

1.   My wife received no information packet from the Kiev embassy.  It all came from the NVC including the notice of the date and time of her interview as well as the medical exam instructions.  IIRC, the information sent to her was in Russian, but I'm not sure.  I'll have to go back and look at what they sent her.  In the last steps they were sending me a copy of everything that they sent her, so I got them first and usually e-mailed copies to her to begin filling out.

2.  The DS-230 needs to be filled out online.  I got all of the information from her, filled it out myself, printed it off, scanned it into my computer and then sent her the completed copy to sign and date so it was all ready to go when requested.

3.  I put no on this part because my wife's English is pretty good and she could have reasonably completed this herself.  If your wife's English is poor and she puts no, they may question this.

4.  The medical exam is now only done at the one clinic. My wife had no problem scheduling an appointment for whenever she wanted and arranged to have it the day before her interview.  Our KEV number was assigned to our case when it reached the NVC long before it ever got to the embassy.  We were sent a letter advising us of this and showing the number.  We had no option to request an interview date.  It was assigned us by the NVC.
Contrary to Zadan's experience, I had no problem reaching the embassy by phone at the number they gave.  The problem was that it was a complete waste of money because all I got was a Ukrainian man who could offer no specific information, only quote guidelines and could not give me the number of anyone who could help me in more detail.  My first e-mail inquiry to the embassy took 2 days for them to answer and ignored my specific questions.  My second one was answered the next day and was very specific, maybe because they realized that they had made an error that had delayed her visa getting to her.

5.  If your wife does not have a record of having received all of the listed vaccinations that are required to show to the clinic, she must receive them there, prior to the interview.  My wife took the list of required vaccinations to her local clinic and for a small fee he gave her a stamped letter stating that she had received all of these.  Still, she had to have the German measles vaccine at the clinic in Kiev.  She will not be allowed to immigrate if the embassy does not have evidence that she has received these vaccinations, so even if she gets and passes the interview, they may hold things up until they can provide this.  Better to get it done well in advance.

6. As I stated before, it didn't seem like a problem for my wife to make an appointment for whenever she wanted.  they just told her to come in that day sometime between 9am and noon.

7. Our case was completed at the NVC on July 2 and shortly after this we received a letter saying that her interview was scheduled for August 16th, about 6 weeks later.  We had been required to send the processing fee, the affidavit of support information, the police certificate and our original documents including birth and marriage certificates to the NVC so all my wife had to bring with her to the embassy was her passport, the medical exam report and the passport photos.  They returned all original documents to her at her interview.

When I was first trying to know what the sequence of steps was and what was involved in each step, I had many of the questions that you had and received many of the same answers.  Our experience was so totally different than what I had heard from anyone else that I had to just wait for the next instructions from the NVC and try to avoid anticipating anything.  Depending on where you are in the process and what route you are taking, it will be easier to see as things progress what you can expect and if it looks like it will go the same way mine did, I think I can be of great help.

Just a quick update for future reference:  On one of the documents it asks if you want to have the application for the social security number submited by them at the Port of Entry.  I checked the yes box.  As a result, there was no need to go to the social security office to apply for this after her arrival.  Her social security card arrived in the mail 10 days after her arrival.
